Charged with assault and battery, Davenport was accused to striking and knocking down Mrs. Stella Holmes, 113 N, Traub ave, who was on crutches @gecovering from a broken leg. She testified he struck her when she protested his taking her vacuum cleaner away for repairs without leaving another in its place as the sweeper company had promised,
. Davenport had been fined $50 and | sentenced to 30 days in jail several] weeks ago by Judge Joseph Howard |
in municipal court. He appealed the case to criminal court. Judge pro tem. Richard Smith in eriminal court gave Davenport his cheice of paying $750 or accepting lower court's fine and jail sentence.
