Law Not Effective Until June 1

By NELSON W. NEAL United Press Staff Correspondent Toy cap guns are still “definitely illegal” in Indiana, state officials sald today. The tranquillity of virtually every Indiana community came to an abrupt end immediately after the 88th general assembly legalized toy pistols and paper caps. Eight years of comparative peace among the Hoosler kiddies was disrupted with make-believe gangland wars and wild west shootings. But spokesmen at the state house told the United Press today that the new law would not become effective until June 1. For “firing, displaying or selling” such equipment, explained the state officials, violators — including parents, their children, wholesalers and retallers—were liable to a $100 fine, 90 days in jail or both,

Outlawed in 1939 Herbert Kenney, chief of the state legislative bureau, pointed out cap guns and allied toys were outlawed in 1939 by a law which at the same time outlawed all types of fireworks except those used in approved displays by licensed operators. However, senate bill 200, passed in the recent general assembly, separated cap guns and their ammunition from the 1939 law and put them back in the hands of the younger set—eflective June 1. Mr. Kenney said that many parents, church-groups and parentteacher clubs, provoked in the first place because such toys had again been legalized, became even more angry when the retail stores jumped the gun and offered the toys for sale immediately after the law was passed.

No Arrest Orders “I receive several calls every day from people wanting to know who's responsible for all the noise,” Mr. Kenney said. “When I tell them that firing cap guns is really illegal, they become even more angry and usually threaten ‘to do something about it’. "” As yet, however, state and city police say they have had no orders to clamp down on illegal sales or use of the toy.
