Mr. Harper charged that he was libelled in Herald-American dispatches reviewing a probe by Governor Ralph Gates of Indiana into alleged Communist activities at state-supported schools in Indiana. His ‘suit gharged that the dispatches used the word “Communist,” “red” and “red fascist” so that they were “reasonably understood by the reading public to apply to the plaintiff.” The petition alleged the dispatch was so phrased as to imply that Harper was “unlawfully using his academic position.”
