Police found Hayes emerging from the door of Elkovits market, 1306 N. Capitol ave, shortly before midnight. They had been sent fo the market when the, store’s burglar alarm sounded. Hayes, who had broken the: glass in the front door to gain entry, ran from the store and south on Capitol when police pulled up. Patrolman John Mickey gave pursuit, firing three times at the fleeing man after he ignored orders to halt. Hayes was struck by the third shot. Police satd nothing was taken from the market,
