y Votes ‘No’ on Move to Cite | Anti-Fascist Group.

Times Washington Bureau WASHINGTON, April 17.—Returning here from his senatorial campaigning in Indiana, Rep. Charles M. LaFollette, Evansville's “radical” Republican, at once cast a dissenting vote. He was one of 56 congressmen {who voted “no” when the house un{American activities committee's |latest contempt proceedings passed | with a bipartisan vote of 292. | ~ Held in contempt are 16 directors of the joint anti-Fascist refugee {committee and Miss Helen R. Bry|an, executive secretary, The house jon March 28 voted 339 to 4 to hold Dr. Edward K. Barsky, committee |chairman, in contempt. All are (charged with failure to deliver | books and records sought by the un- | American committee under subpena. Opposed Rankin Request | “I voted against the Rankin comimittee’s request for a blanket con- | tempt citation against all of the | members of the executive board of the joint anti-Fascist refuge committee,” Mr. Lafollette explained in a prepared statement. “Had I been present last month I would have voted for a citation against Dr. Barsky. But the record before the congress in this case | failed to disclose such direct con- | tempt of the committee's subpoena | power as to justify me in finding a reciratie showing of contempt to | justify my voting a citation. “The issue of Communism or its propagation was not present. The issue of restrained use of congres- | sional power, so as to keep it digni- | fied, was present. I voted in keeping with my standard of congressional | dignity.” | Joined by Madden Rep. Ray Madden, Gary Democrat, cast the only other “no” vote |from Indiana. He explained that {the thought when Dr. Barsky was {held in contempt that was enough. | “Dragging in all these others looked to me like the un-American {committee was just trying to show off,” Mr, Madden said. Rep. Gerald W, Landis (R. Ind.) is a member of the un-American committee. He said they also will ask the house to hold Chairman Corlis Lamont and Richard Morford, executive directgr of the National Council of American Soviet Friendship, and Chairman George Marshall of the Nation Federation for Constitutional Liberties in contempt. They also failed to deliver {the records wanted, he explained. Calls Them Communists

“All' 'of these are Communistfront organizations and therefore un-American,” Mr. Landis argued. “There are 50,000 Communist party members in the United States, 500,~ 000 fellow-travelers, and 150,000

members of the underground. Mr. Landis said he got the figures from the FBL In an interview with Edwin A. Lahey, noted labor reporter, last week William Z. Foster, national secfetary of the Communist party, claimed a 70,000 membership. A drive is under way to get 20,000 new members, he said. “I believe that the Communist party should be outlawed and our committee may draft legislation to outlaw it,” Mr. Landis declared. “This would be done on the grounds that it is-dedicated to overthrowing the government by force.” : 3
