Supreme Court Writ Ties . Up New Trial Move.
D. ©. Stephenson, former grand dragon of the Indiana Ku-Klux Klan, today faced the possibility that his latest attempt at freedom from prison would end as all the others—in failure, ‘Stephenson, who once -boasted that he was “the law” in Indiana, and who has served 20 years of a life term imposed in the slaying of Madge Oberholtzer of Indianapolis
in 1925, was blocked by an Indiana supreme court decree. While he studied stacks of law books in the Hamilton county jail at Noblesville, the state's highest court temporarily halted any further action on Stephenson's motion for a new trial by tying the hands of Circuit Judge Cassius M. Gentry. The court issued a temporary writ prohibiting further proceedings before April 17 and makes it unnecessary for Attorney General James A. Emmert to file an answer to Stephenson's’ motion by April 2. Gentry had" given the state the right to file an answer by that date. On April 17, the supreme court will decide whether the writ should be made permanent. In the event the writ is not dissolved, Stephenson might find further legal steps stymied. On March 5, Stephenson argued
