ALBANY, N.Y, Dec. 1 (U. P).— The court of appeals in a five-to-two decision yesterday held that Charles Chaplin, Hollywood actor and film producer, could sue Vanguard Films, Inc, in New York state for an accounting of $1,000,000 alleged profits from film transactions. + At the same time, the court by a five-to-two vote, reversed a lower court ruling which would have permitted Chaplin to bring a similar accounting against David O: Selznick Productions, Inc. Selznick Productions and the Vanguard concern contended that their business was in California, that most of the witnesses and Chaplin resided there, and that proceedings for the dissolution of 8elznick’s company already were under way there. Chaplin contended that the $1,000,000 involved in the proceedings was made by Selznick Productions and Selzhick from leasing actors, actresses and technicians and rights to three movies: “Keys To the Kingdom,” “Claudia” and “Jane Eyre,” to 20th Century-Fox film corporation. Chaplin, in hls brief, said that in 1035 Selznick International Pictures, Inc, controlled by Selznick and John H. Whitney, had contracted to produce four pictures for distribution through United Artists corporation of which Chaplin is a stockholder, Two of these pictures were not made, Chaplin contended, even though Selznick Productions had agreed to carry out the obligation when International Pictures was
