To Appear or Yield Bond
several months ago, to appear for trial ‘although the case was set for hearing twice, brought an -ultimatum from Judge W. D. Bain of criminal court today. .
The judge reset the case for Aug.|
11 and warned that if Ferguson fails to appear for trial the $1500 bond, signed by Marty Frankfort,
‘| professional bondsman, will be for-
feited. Investigation of Ferguson’s failure to appear when the case was set for trial originally last week revealed that neither the defendant nor the bondsman had been notified, according to Judge Bain.
No-Subpena Sent There was no record showing who
Ferguson’s bondsman was, hence no|
subpena had been sent to Bondsman Frankfort. The case was called for trial again’ yesterday but Ferguson still didn't show up and his attorney, William B. Miller, explained “that Frankfort didn't have sufficient time to find the defendant and have
‘him in court.
Failure to notify the bondsman brought orders from Judge Bain for a general revamping of the
. |court’s bond record system.
Judge Bain said that in many cases only the amount of the bond is shown on the record, with no entry showing who the bondsman is. In the future, he said, court clerks will be instructed to enter the name of the bondsman along with the name of the defendant on the indictments and affidavits.
