LIMIT DECREED ON PROBATION

Cannot Exceed the Maximum Sentence, Judge

Cox Asserts.

Judge Earl R. Cox of circuit court has ruled that no defendant in a criminal case can be placed on probation for a period longer than the maximum sentence given in the

case, ; He ordered John Zener, 30, released from jail following a habeas corpus hearing in which the defendant charged that revocation of his probation In a year-old case was illegal. He was convicted a year ago on a charge of disorderly conduct and “was sentenced to 60 days by Judge John Niblack. The sentence was suspended but Zener was placed on probation for a year. Recently Zener was arrested on a gaming charge but was found not guilty. However, Judge Niblack revoked his probation in the previous case and ordered him to jail last week. “The period of the maximum sentence suspended in any case is as long as a court has any hold on a | defendant,” Judge Cox ruled.
