Hawaiian Commander Says Judge Will- Be: Jailed If-He Persists.
HONOLULU, Aug. 26 (U. P.)— Lt. Gen. Robert C. Richardson Jr. commander of ‘the “Hawaiian: military department, ‘threatened today to jail Federal Judge Delbert E. Metzger if he tries to make him ‘pay a. $5000 contempt fine. Metzger’s only comment was: “The Stars and Stripes still fly overhead and the constitution will be there when the dawn br Richardson prohibited all habeas corpus suits in the ‘territory and specifically ordered ‘Metzger's ‘court to halt proceedings against himself for refusing to produce two Amerfcans of German extraction in court. “The penalty for viciaion of the "order would be a $5000 fine or five years imprisonment, or both. dispute over whether civil or military authority ‘is paramount in the territory. Court-Martial Threatened Richardson's official pronouncement explained the action ‘was necessary to “safeguard this community in time of war.” - Any judge attempting to interfere “with the commanding general of the Hawaiian department or any member of the armed forces” will be subject to action before. the military provost marshal, he said. i The original case arose in’ Metzger’s court where the two Americans interned after Pearl Harbor by the military brought habeas corpus proceedings contending they were held unlawfully. Metzger issued writs on Richardson ordering him to produce them in court and held that military suspension of the right of habeas corpus had been voided by restoration of other civil rights in the islands last March when martial law, imposed after Pearl Harbor, was partly lifted. Fined for Contempt Richardson refused. Yesterday Metzger declared the general was in “open, notorious disregard” of the court and fined him $5000 for contempt. Immediately District Attorney Angus M. Taylor, representing Richardson, filed the general's order naming Metzger specifically and gave notice of appeal. Richardson made clear that court actions other than habeas corpus were not suspended. The order not only directed Metzger to discontinue the current habeas corpus action, but stop “any matter, action or proceedIngs arising out of, related to or in any way connected” with it. This included the contempt charge. ~
