6 Senators, Representatives Join Bloc Raising Total

To 80 in Congress.

MARSHALL McNEIL Times Special Writer WASHINGTON, July 16.—Two more senators, including the Republican floor leader, and four more members of the house, can now be added to the community property bloc in congress which stands ready to fight the treasury if it again proposes to eliminate the income tax privileges enjoyed by married taxpayers in the community property states. The state of Oregon now has its own community property low, bringing to 10 the number of states with this tax-saving law. They are in two categories. In one are the eight states which inherited their community property principle from the old Spanish and French laws. These are: Texas, Louisiana, Washington, Idaho, New Mexico, California, Arizona and Nevada. In the other are two states which adopted community property laws in order to retain within their borders rich men who, otherwise, they feared, would move to community property states to save money. The first of these is Oklahoma, and now, Oregon.

Court Upholds Law

The Oklahoma law, attacked by! {the treasury, has been upheld by the U. S. court of tax appeals. But this decision is being appealed to the federal courts and eventually, Ht is presumed, will be passed upon {by the U. S. supreme court. What{ever is decided in the Oklahoma case will apply to the Oregon law. | The supreme court has upheld the {law in the case of the eight states |in the first category. In the community property states, 'a married man and his wife are re- | garded as the joint owners of the | family income and property. They {file separate income tax returns. t the husband has a $10,000 salary, i he files a tax return of $5000 and his wife on the other $5000. Thus they | escape the higher surtaxes. The treasury has tried for years | {to get congress to eliminate the| | community property privilege.| | Treasury secretary Morgenthau has | argued that this is one of the big-| gest tax loopholes, and should be closed. He has favored at one time | or another forcing married couples | everywhere to file joint returns, or| requiring married couples in the community property states to file joint returns.

Treasury Loses on Floor

With the eight states having 16 | senators, and 64 house members, the | treasury has won a time or two in the tax writing committees, but never on the floor. 1 Now, with Oregon and Oklahoma having passed community property laws, any renewal of the treasury’s efforts doubtless will be opposed by 20 senators and 76 members of the house. And in the senate, if 20 members stick together, they can block ck almost any legislation.
