on soft white sands with pretty French girls today while behind them lay the bomb-shattered city of Gabes, which they had occupied without firing a shot. The city had been heavily damaged by British and American bombers pounding Marshal Erwin Rommel’s communications, but the population welcomed the British soldiers with hugs and kisses. Gabes’ population of nearly 2000 French and 6000 Arabs had suffered greatly in recent months during the German occupation. Local people with whom this correspondent talked on a tour of the town’s white stucco buildings said the

The blond 19-year-old daughter of a local air raid precautions chief, synning herself on the beach, said that Gabes had undergone an air raid Sunday night just before the axis troops started to evacuate -the city. “We are convinced,” “she said, “that German planes bombed us— not British or American—because they wanted us to hate you when you arrived.”

EISENHOWER COMMUNIQUE (Issued Friday, April 2)
The Tunisia front was generally quieter yesterday. Our patrols were very active over the whole front. In the north, our troops continued to push northward and eastward beyond Sed Jenane. AR On the night of March 31-April 1, our bombers attacked the docks at Bizerte. Yesterday a large force of medium and light bombers attacked El Maou airfield at Sfax with good results, Ta airfields at La Fauconnerie and Djem were attacked by formations of light bombers and fires were left burning. Air operations in northern Tunisia were restricted by weather but fighter sweeps were maintained over the sector from Fondouk to El Guettar, and attacks were made on enemy vehicles. | Nine enemy aircraft were destroyed during all these operations and four of our aircraft are missing.

From 86th street to the South side is a long haul, but apparently not long enough for the ODT. Unless the works bosrd receives a special exemption from an ODT drder banning civilian stipments by tank car of less than 200 miles, it may have to pay $500 more for cne thousand tons of asphalt. The Highway Co. of Zionsville, with a refinery at 86ih st. has offered to supply the asphalt for $1560. ] However, the ODT c¢rder leaves the North side refinery without facilities to transport asphalt from one end of the town to another. Second lowest bid of $1610 was submitted by the Shell Oil refinery at Roxanna, Ill, mor¢ than 200 miles away. The works board may be forced to accept this offer. Board officials explain that asphalt must be shipped in heated tank cars. Tank trucks do not have heating apparatus, they say.
FARM LABOR CHIEF APPOINTED BY DAVIS
WASHINGTON, April 2 (U. P). —Food Administrator Chester C. Davis last night appointed Lieut. Col. Jay L. Taylor as deputy administrator in charge of farm labor, apparently assigning him the task of recruiting a land army of 3,500,000 to help. produce 1943 crops. Taylor was detailed fo the food administration from the army, where he has bcen serving as g.liason officer in the fiscal division of the services of supply at Ios Angeles. He assumes his new post at once. Taylor, 41, of Amarillo, Tex. is an experienced farmer, the food administr#tor said. He 'has raised livestock and major staple crops on his ranches in Texas, Oklahoma and New Mexico.

Mrs. Mona P. Lundy, 365 Grand ave.,. died at her homg yesterday. Mrs. Lundy, who was 57, had lived in Indianapolis about 35 years. She was a graduate of Methodist hospital training school for nurses and retired from the profession about 16 years ago. Survivors are the husband, John Lundy; a brother, Everett Phillips, Terre Haute; two sisters, Miss Maud Phillips and Miss Ora Phillips, Liston, Iowa. Services will be held at 2 p. m. Monday at the Callahan funeral home at Terre Haute. Burial will be in Oak Hill cemetery.

Test Suit Filed The question was raised by attor-, neys here today while delving into the complications surrounding the

A suit was filed in circuit court yesterday by County Attorney Victor Jose Jr. in behalf of a taxpayer, demanding that local township assessors be enjoined from making the enumeration, due this year, on the ground it would be a useless expenditure of money because the list would not include women voters. The constitution was never changed to include women voters when the suffrage amendment was added to the constitution in 1920. “Therefore, the law providing for assessors to make the enumeration of male citizens only is unconstitutional and the work should be prevented by court order,” Mr. Jose said. Order Readjustment
Examining the state constitution it was found that the document provides specifieally that the legislature must reapportion its membership on the basis of enumeration of male citizens over the age of 21 every six years. The last reapportionment of the legislature was made in 1921. The next one was due in 1927 but nothing was done then, nor at any time since. Article 4, section 4 of the state constitution reads: “The general assembly shall, at! its second session after adoption of | this constitution, and every six] years thereafter cause an enumeration to be made of all male inhabitants. ; Article 4, section 5 reads:
“The | number of senators and representatives shall, at the session next fol-| lowing each period of making such! enumeration, be fixed by law and! apportioned among the . several! counties according to the number of male inhabitants over the age of 21 years.”
Fail to Legislate
County Attorney Jose contends that section 4 means the legislature should have passed a law every six years to “cause” the enumeration but that no such laws were passed. There is no dispute about section 5 which clearly ‘mandates the legislature to reapportion itself every Six years. - Just: who is to blame for the discrepancy has been disputed. 'Legislative leaders have blamed it on some county officials for failure to make any enumeration under the law while county officials are blaming the legislature for not giving them a law on enumeration that conforms with the constitution. At any rate, the constitution is Clearly violated by faiure to have any reapportionment for 16 years— if any one wanted to.push the issue. There’s a big headache, too, in the event the legislature or the courts should happen to declare the assembly invalid because if the legislature is unconstitutional, how can it function legally enough to pass a law to make itself legal?
