CARSON CITY, Nev., Dec. 1 (U. P.).—A stay halting the execusion of Floyd Loveless, 16-year-old Indiana slayer, was issued by the Nevada supreme court yesterday. Loveless, convicted of the first degree murder of A. A. Berning,
Carlin, Nev., constable, was scheduled to have died in Nevada's lethal gas chamber during the week of Dec. 13. An appeal in the case was filed yesterday by Taylor H. Wines, Elko attorney who represented Loveless at his trial a few months ago. Loveless, who escaped from the Indiana state reformatory at Pendleton, with Dale Cline, also 16, shot and fatally wounded Berning when the constable sought to question him about a stolen car, Aug. 13. Cline, who was not with Loveless at the time of the shoting, testified for the state and later was sent to “a federal reformatory on a charge of {transporting a stolen automobile in .interstate commerce.
