Four Farmers Challenge Constitutionality of Wheat Quotas.
By UNITED PRESS ‘Four DuBois county farmers, in .|the first test suit of its kind in the | | state, today sought federal ' court | judgment on the constitutionality ‘lof the agricultural adjustment ad-
ministration’s wheat marketing ‘quota law and a permanent injunction against the AAA collection of marketing penalties. The suit charged that the AAA act, as passed by congress in May, 1941, gave unconstitutional powers to the secretary of agrichlture in alloting production quotas to be fixed by him, together with the collection of penalties, because such powers encroached upon in-state production. The marketing quota act provides for the collection of a 49-cent-a-bushel penalty on all wheat in! excess of a farmer's allotted acreage production. The plaintiffs charged further 2 that the law attempted to penalize farmers for wheat sown months in|4 advance of actual enactment of the law. Named as defendants in the suit, filed in federal court here yesterday, were Secretary of Agriculture Claude R. Wickard; L. M. Vogler, Indiana AAA head, and Bruno Ragee,- vice chairman of the state AAA, Plaintiffs in the suit, similar to others pending in several states, included August Reutman; Herman Frick; William Brackelman and ‘| William Teder.
