STOCKS RALLY,

Send Prices Down on .Big Board.

NEW YORK, Feb. 24 (U. P.).— Stocks rallied fractions to more than a point in moderately active dealings today and then gave up part of the advance when mild profit-taking cropped out in midafternoon. Motor and steel shares led the early rally, meeting short covering attributed to President Roose-

o|velt'’s speech and to belief that

week-end war news was not unfavorable. Chrysler ran up 1% points to a néw 1942 high at 51% and General Motors also hit a new top at 34%, up 3. They held most of the gains. Bethlehem Steel jumped 1% to 61% and U. S. Steel hit 513%, up 1%, before yielding a small part of the gains. Borg-Warner was an active feature, rising a point to a new high. American Tobacco shares, Union Pacific, Douglas Aircraft, Westinghouse Electric, du Pont, International Harvester and Eastman Kodak also were up a point or more. General Steel Castings preferred gained 3% points and Alabama & Vicksburg jumped 5 points to a new high.

Income Tax

Deductions for losses are divided into four classes, and to be allowed must follow closely the wording of the income tax law. Losses'are¢ dee ductible if incurred (1) in the taxe payer's trade, business or profession; (2) in transaction entered into for profit; (3) from fires, storms, shipwreck or other casualties, or from theft; and (4) from wagering transactions. Business losses result, usually, from the purchase and sale of mere chandise. Such losses usually are ascertained by means of inventories, which are required whenever in the opinion of the commissioner of ine ternal revenue their use is necessary to determine the income of any taxpayer. term “transaction entered into for profit” means any kind of business, proposition. For example, a taxpayer purchases an pee i Fo to be used solely for business Fur poses, and which’ is sold at a As this is a business proposition from start to finish, the loss is deductible, But if he had purchased fhe automobile to be used for pleasure or convenience, the deduction would not be allowed; it was not a trane saction entered into for .profit. A |loss sustained in the theft of an automobile purchased for pleasure or convenience is deductible, as it falls in class 3. -If, because of faulty driving but not of “willful negligence,” an automobile maine tained for pleasure is damaged, the taxpayer may claim the loss suse tained, as it comes within the meaning of the word ‘casualty.” Where damages result from the faulty driving of an automobile with which the automobile of the taxpayer. collides, the loss occasioned to the taxpayer likewise is deductible. Losses from wagering transactions, whether legal or illegal, are deducti= ble only to the extent of gains from such transactions. +The excess of such losses over the gains is not deductible. All losses are deductible only to the extent to which they are not compensated for by insurance or otherwise. |
