Leading steels which had made new lows for the year came back fractionally. Chrysler regained part of a one-point decline. Special issues moved over a wide area. Bech-Nut Packing broke 10 points to a new low at 95. New lows were made by Dow Chemical at 110, off 1%, and General Electric 426%, off 5%. Nickel Plate preferred lost nearly 2 points. Patino Mines , (and Allied Chemical were off a point. The decline spread to utilities, farm shares, mercantiles, oils and tobaccos. Amusements, rail equipments and aircrafts were steadier than other groups. Adverse war news from the Far East and the approaching holiday made traders cautious. Markets will close on Thursday for the Lincoln’s birthday holiday.
GRAIN PRIGES HOLD STEADY AT CHICAGO
CHICAGO, Feb. 9 (U.P.) —Grain futures prices were little changed in quiet, early dealings on the Board of Trade today. At the end of the first hour wheat was off z+ to up '& cent a bushel; corn unchanged to off 4; oats unchanged to off ls; rye up to %, and soy beans off %& to up 1%.

No deduction is allowable for losses from sales or exchanges of property, directly or indirectly, between (a) members of a family, (b) a corporation and an individual owning more than 50 per cent of its stock (liquidations excepted), (¢) a grantor and fiduciary of any trust, or (d) a fiduciary and a benefictary of the same trust. If (1) shares of stock become worthless during the year, or (2) corporate securities with interest coupons or in registered form are ascertained to be worthless and charged off during the year, and are capital assets, the loss therefrom shall be considered as from the sale or exchange of capital assets as of the last day of such taxable year. In determining “gain” in case of property acquired before March 1, 1913, the cost, or the fair market value as of March 1, 1913, adjusted as provided in section 113 (b) of the Internal Revenue Code as amended, whichever is greater, should be used, and in determining “loss” the cost, so adjusted, should be used. If the property was acquired after Feb. 28, 1913, the cost, except as otherwise provided in section 113, of the Code as amended, should be used. The taxpayer's return should state the following facts: (a) For real estate, the location and description of land and improvements; (b) for bonds or other evidences of indebtedness, name of issuing corporation, particular issue, denomination, and amount; and (¢) for stocks, name of corporation, class of stock, number of shares, and capital charges affecting basis (including nontaxable distributions).
CHINA CONSIDERING NEW BOND ISSUE
CHUNGKING, Feb. 9 (U. P.).— Authoritative sources said today the government of China is considering flotation of domestic bonds in United States dollars and pounds sterling, which, along with new loans from the United States and Britain, will absorb Chinese legal tenders now in circulation. Another plan reported under discussion is the shipment of a certain amount of United States banknotes to China as part of the United States loan. This plan would involve establishment of an American bank branch in interior China.

DELINQUENT TAX LAW IS PUZILE
Must Be Clarified in Court Before Land Can Be Sold.
Another law passed by the 1941 Legislature will have to be reviewed by the Indiana Supreme Court for interpretation before a single piece of property is sold for delinquent taxes. As a result of the current confusion over the delingent tax sale law, the annual disposal of property to satisfy taxes may have to be postponed or canceled this year.
The new law provided that property, on which taxes have not been paid for five years, must be confiscated by the County Auditor who in turn must have it appraised and sold, presumably at a profit to the county, or is it to the ctiy? Where Does Money Go?
The law doesn't say whether the county shall reap the profits or the city or the townships or where the money should go. County Attorney Victor Jose Jr. said no one has been able to deter= mine that question, “The new law is so complicated and so confusing that we can’t tell anything definite about it,” Mr. Jose said. Another thing the lawyers have run up against is the question of what class cities are included in the property sale law. Also Mr. Jose said holders of Barrett Law public improvement bonds are complaining that if the county takes over property for dee linquent taxes, how will they collect on their bonds?
Court Ruling Needed
“These are just a few of the technical questions arising from the law and the courts will have to decide before anything can be done,” he said. Under the old law, the County Treasurer merely advertised delinquent tax properties for sale at pub= lic auction and they were sold to the highest bidder. A group of Barrett Law bond holders filed a suit several months ago for a restraining order to prevent the auditor from taking over any property until the legal ques= tions have been settled.
