Superior Judge Russell Ryan has ruled that the City Health Board's method of collecting fees for milk inspection is illegal. He issued a temporary injunction, restraining the City Health Board from collecting 1 cent per hundred- { weight from milk producers to pay the inspection costs. Following the ruling Dr. Herman Morgan, Health Board secretary, said that his department would have to appeal for a special appro{priation to pay the inspection costs. | The ruling was made on a suit [brought by six milk producers who | declared the collection system was (illegal. | ‘The collection is called the “check-off” system whereby distribu- | tors withhold 1 cent per hundred- | weight from every producer and {turn the proceeds over to the City.
