Indiana Municipal League May Take Fight to

Marion Courts.

The Indiana Municipal League today prepared to take its fight against payment of the gross income tax on municipal revenueproducing activities to the courts. Meeting in Indianapolis yesterday, officials of 30 Hoosier cities: and towns instructed the league to proceed with court action which probably will be filed in Marion County. The officials branded the State's move to collect the tax as “unfair,” asserting that State revenue-pro-ducing activities such as State parks and institutional manufactures are tax exempt. Gilbert K. Hewit, State gross income tax director, notified the cities and towns of their liability for taxation on golf courses, swimming pools and publicly-owned utility

cities, including Indianapolis, protested. Collection Threatened

The officers of the Indiana Municipal League decided to file a test suit at Evansville last summer, but this action was never taken. The controversy dragged on until this spring when the Gross Tax Division threatened to press for collection. The League asked all cities affected to contribute to a war chest to fight the gross tax demand and called yesterday’s meeting to make a final decision. The State is attempting to collect the tax under an interpretation of the 1937 law which gross tax officials believe classifies munieipal revenue-producing activities as “private and proprietary.” The League refutes this contention, asserting that since these municipal functions are partially tax-sup-ported, the State’s move is an attempt to “levy a tax on a tax to pay a tax.”
