Edward Bowes Amateur Hour salute to Indianapolis. - With them. will be Frank Mc? Grath, district manager here for the Chrysler Sales Corp.; T. E. (Pop) Myers, Speedway general manager; Wilbur Shaw, three-time winner of the 500-mile classic, and Walter I. -Longsworth, Chamber of Com- . merce president. It will be the first time an entire Plymouth organization from any city has attended the broadcast which is sponsored by Chrysler. "When two attendants at a filling station at 2733 Central Ave. looked up at the doorway and saw an armed bandit last night they didn’t throw up their hands and surrender their cash. : Instead, they lunged at the bandit. During the scuffle, the robber pulled the trigger of his gun but it didn’t discharge the first time. He fired the weapon a second time and jerked from his captors. The attendants, neither of whom were hit by the bullet, ran after the gunman, caught him again but he slipped loose, escaping down an alley. _ The attendants were Willard Nowling, 27, of 2924 Ruckle St. and Charles Smith, 34, of 2101 Guiord Ave.
DELAY ARRAIGNMENT “OF DEATH SUSPECT

P.).—Arraignment of = Cozzie Merrill Jones, 24, on a first degree murder charge in the attack-slay-ing of 12-year-old Edith Idelle Barton was postponed today until June 2 by Judge John W. Gerdink. Jones appeared in the crowded courtroom without counsel and Judge Gerdink appointed Herbert Gerdink as pauper attorney to represent him. : The arraignment was set back beeause the attorney had not seen or talked with Jones before. £0

NEW CASTLE, .Ind., May. 21 (U. P.) —Arthur Livzey, 70, was burned fatally yesterday while burning weeds on his farm near here. Coroner Ralph :Niblock said he apparently suffered a heart attack.

Woman to Fight ‘Prison Term in Two 1937. Traffic Deaths.
Attorneys for Mrs. Mary Runyon, State Health Board employee, today began a legal fight to prevent her commitment to the .Indiana Women’s. Prison. : Mrs. Runyon was sentenced to one year in prison and fined $25 and costs by Judge Dewey E. Myers in Criminal Court yesterday after the judge found her guilty of failure to stop after a fatal traffic accident. When the State rested its case after two days of testimony, defense attorneys announced: they would present no defense testimony and asked for a direct acquittal. This was refused. .
Score Take Stand
More than a score of witnesses, called to the stand by Prosecutor Sherwood Blue, told of the accident in which Noah Russell and his four-year-old daughter were killed while walking along U. S. Highway 40 near Bridgeport Dec. 4, 1937. Deputy sheriffs testified that Mrs. Runyon came to their office two days after the accident and reported that “something hit her windshield” while driving near Bridge-
know she had hit any one. Otto ‘Ray, former sheriff, said examination of Mrs. Runyon’s car showed a large hole in the winsnield and a broken headlight. A piece. of glass found near the accident scene was introduced in evidence as corresponding to the hole in Mrs. -Runyon’s windshield.
Claims Guilt Evident
Prosecutor Blue, in his.argument to the court, said that a summary of all the evidence “proves conclusively beyond any doubt that Mrs. Runyon was the driver of the car
failed to stop and report it.” Frank Symmes, defense attorney, said the State had failed to prove that Mrs. Runyon had any knowledge of an accident. Judge Myers said that “under the evidence I will have to show a finding of guilty.” When sentence was pronounced, Mrs. Runyon broke down and wept.
Seek New Trial
Defense attorneys asked for time to file a motion for a new trial and Judge Myers gave them until June 2 for the action and permitted Mrs. Runyon to remain free under $1500 bond until the new trial hearing. Defense attorneys indicated that if the new trial motion is overruled they will proceed immediately to appeal the case to the Indiana Supreme Court. .
