WASHINGTON, May 5 (U, P.).— Radio company officials predicted today that new regulations issued by the Federal Communications J omnision faced an early court t.
The regulations, issued Sunday by a 5 to 2 FCC decision, would force the National Broadcasting Co. to relinquish one of its networks probably the “Blue,” and cause general readjustments in the broadcasting industry. Niles Trammell, president of the National Broadcasting Co. charged last night that the new regulations are “a definite step toward complete Government control of radio;” that “chaos, not further competition, would result from the blow aimed at the American systém of broadcasting.”

Injunction May Be Asked
The court challenge was expected to be in the form of a petition for Injunction in the Federal District Court here and would seek to restrain enforcement of the new orders. “An FCC official said the Commission’s report probably would be forwarded to the Justice Department’s anti-trust division for study of possible Sherman Act violations. It was alleged that some contracts now existing in thé industry concerning the sale of radio time virtually constitute a price-fixing agreement dictated to the outlet stations by the networks. NBC, which now operates both a Red and Blue network, would be forced to relinquish ownership of one by a regulation which would forbid any station to be affliated with a company maintaining more than one network. The Blue, being less profitable, is the one that probably would be disbanded or sold.

Fred Weber, general manager of the Mutual Broadcasting Co., criticized President Neville Miller of the National Association of Broadcasters for his statement that the regulations constituted “an usurpation of power which has no Justification in law and menaces the freedom of the American system of broadcasting.” Columbia Broadcasting Co. President William S. Paley criticized the Commission's report as an attempt to make the networks and stations “impotent vassals, able to survive only so long as they please the regulatory authority.”

Times Special LAFAYETTE, May 5.—Indiana’s tomato picking contest will be held near Vincennes sometime during the second or third of August. Roscoe Fraser, Purdue extension tomato specialist, said the exact date and place will be designated later. Each canning factory in the state will be permitted to enter one picker. Sponsors of the contest are Purdue Agricultural Extension Service, Indiana Canners Association, Vine cennes Chamber of Commerce and Vincennes Packing Co.

SAN FRANCISCO, May 5 (U. P) —Hans von Bernhard, commercial attache to the German consulategeneral in San Francisco, has resigned, rather than obey an order from Berlin transferring him to Japan, the San Francisco Chronicle said today. Von Bernhard, a 37-year-old Ger-man-born engineer, the Chronicle said, declined to reveal his reasons. He had been working for the consulate since December, 1933. Close friends with whom VonBernhard took counsel when he was ordered to Japan on March 13, said he “was fed up with the whole business and during the past year had protested against carrying out some of the instructions received by the consulate from Berlin.”
