Facing Death

The Indiana Supreme Court to- ; day saved Richard Sweet, con- } demned state prisoner, from death ! in the electric chair next Thursday. : Sweet was convicted and sentenced to death more than a year : ago for kidnaping Mrs. Ruth Joiner, ; Grawfordsville, welfare worker, and : holding her as hostage in an ate ¢ temfit to escape from State prison. * The Supreme Court ordered a new ! trial of the case on the ground that { ! the trial judge’s instruction to the ‘ jury was erroneous and because + “the facts in this case do not justify : the death penaity.” . The decision stated that Special ; Judge William Murray’s instructions » to the jury were not “worded cor- ® rectly” in his reference to the jury’s » duty in determining the defendant’s ! sanity. Sweet, who was serving a life term i for kidnaping and robbery, grabbed « Mrs. Joiner while she and other + welfare workers were going through the prison on June 27, 1939. i The convict shoved Mrs. Joiner ¢ into the doctot’s office and demand*ed guns and a car from the war- . den under threats to kill Mrs.

in the ensuing battle of State Police and guards to free her. Sweet was placed in solitary confinement. He was tried and convicted on the kidnaping charge in La Porte Circuit Court.

The Sweet case was used by Rep. Jess Andrew (R. West Point) in arguing for passage yesterday of a bill eliminating the State Welfare Department’s supervision over paroles. “No woman should ever be allowed in the State Prison,” he said. “If Sweet’s sentence is not commuted, I'll charge his electrocution to the Welfare Department.” Rep. Andrews’ bill was passed unanimously in the House late yesterday. Rep. Andrew also criticized the Welfare Department's keeping some prisoners in custody after they have been paroled.
