2 SENATE SUITS

Committee Hears Sexton; Stanton Scheduled to Appear Today.

After dawdling over the matter for more than half the legislative session, the G. O. P.-controlled Senate Elections Committee is expected to rule this week on whether two members of the Upper House * have a right to their seats. The Committee yesterday heard evidence on the contest suit against Senator ‘Albert J. Beveridge Jr. (R. Indianapolis) and it will hear evidence this afternoon on the contest against Senator Blaz A. Lucas + (D. Gary). Joseph F. Sexton, former Marion County Senator who lost to Senator Beveridge by 51 votes, told the committee that he had lost the election because of a faulty voting machine in the 13th Precinct of the 12th Ward.

N ot Reasonable,’ He Says

He explained that all other Democrats received 363 votes in that precinct while he obtained only 244. He said that the Republican candidates all got 167 votes. “It just isn’t reasonable,” he declared, “that I should be scratched that many times and none of the Republicans pick up any more votes. can be reached is that the machine made an error.” He said he had obtained affidavits from 331 voters in the precinct that they voted the straight Democratic ticket. Mr. Sexton asked that the committee rule that he is the legally elected Senator and seat him in _ Senator Beveridge’s place, He 8s- ~ serted that he had no personal animosity whatsoever against Senator Beveridge.

~. Dismissal Asked

Robert Armstrong, Indianapolis lawyer, appeared for Senator Beveridge, who was conducting a meet-

ing of Senate Judiciary’ Committee C at the time of the hearing. Mr. Armstrong asked that Mr. Sexton’s suit be dismissed on the grounds that he had failed to include the other Democratic Senate nominees and that he had already exhausted ‘his remedy for relief through the recent county recount which showed Mr. Beveridge the winner. Senator Braxton H. Bearss (R. Peru), committee chairman, said the committee would decide the matter in a closed meeting soon. The contest against Senator Lucas was brought by David Stanton, Gary, a Republican attorney who was defeated ‘by more thagp 25,000 votes.: Mr. Stanton contends that Senator Lucas is not eligible to hold a Senate seat since he served one year and a day in 1923 in the Federal Prison at Atlanta, Ga., for conspiracy to violate the Volstead Act. 1

Both sutlmiobiles had been used by their Democratic predecessors, The State Auditor asked Anderson Ketchum, State Budget director, to assign the cars to some other department = “where they are needed.” “The duties of the auditor's office are such that they do not make it necessary for me nor my deputy to do any extensive traveling on State business,” Mr. James said. Similar action was taken two years agp by Secretary of State James Tiicker, also a Republican, when he took office for the first time. He found that he had no need for an official car and turned his car, 8 Chrysler Airflow, back to the state. There is now law, however, permitting the sale of such Stateowned property and Mr. Tucker's car has been sitting in the State Highway Garage, on four flat tires, since that time. The only way such property can be disposed of is to trade it in on something else. Mr. James said he was in favor of a bill introduced in the House by Rep. Charles T. Miser (R. Garrett) to permit the State Auditor to sell any unnecessary piece of State equipraent or supplies after publication of notice. Counties and cities are tobe given priority in bidding on the equipment, the bill provides. “If this bill becomes law,” Mr. James said, “it will be possible for any State Department to dispose of equipment no longer needed by that

Neither Mr. James nor Mr. Teckemeyer have used their autobiles since they took office Dec. 1.

He's Very Alive, But Legally Dead

EL PASO, Tex, Feb. 11 (U. P). —Leonardo Trevizo has been legally dead for a quarter of a century. The 25-year-old El Pasoan found that through some error cnunty records show he died at birth, and through a quirk of law he has been dead since as far as the state is concerned. The notation ‘“dead at birth” bore the name of Leonardo’s mother and of the midwife who attended her. A deputy county clerk discovered the error while searching for evidence of a birth certificate issued for Leonardo’s brother. “As tar as the county clerk’s office is ncerned Trevizo must remain legally dead -untit his father signs a certificate of correction,” the deputy clerk said.

TRUSTEE BUDGET MEASURE URGED

House Committee Supports Passage to ‘Clean .Up’

and Means Committee. This measure is part of the program of the Indianapolis Chamber of Commerce and several state-wide groups to “clean up township relief in the state.” One. part of the program-—the

.|“little Hatch Act” for trustees—has

been killed by the House. Other measures still are in committees. The Ways and Means Committee made one amendment to the bill. It provided that in case of emergencies in which the trustee had insufficient funds, the trustee could ask the County Auditor to advance him. the emergency fund. Rep. Walter Baker (R. Bourbon), who drafted the amendment, cited several cases in which the trustee would “have his hands .tied” in event of an emergency as the bill was drafted originally. William Book, Chamber of Commerce executive vice president, said “there are other and better ways of getting at the problem, but in the interests of getting the bill passed I'll go along with it.”

FATHER OF 42 DIES OF CRASH INJURIES

HUNTINGTON, Ind. Feb. 11 (U. P.).—+Prentice Fluker, «86-year-old Detroit Negro who told attendants at the Huntington Hospital he was the father of 42 children, died today of injuries received Saturday when the automobile in which he was riding collided with a fire truck here. Two firemen were Kkilled in the crash. : He admitted his extensive family after nine of his children visited him at the hospital. A tenth, Roger, 23, who was involved in the accident, is in “fair” condition, the hospital announced.

Federal District Attorney B. Howard Caughran tomorrow will file a brief in opposition to the latest appeal of Carl F. Kortepeter, former Marion County WPA co-ordinator, for a new trial. Mr. Kortepeter, acquitted in a WPA fraud diversion trial last week, was convicted in December, 1939, on a similar charge. His attorney; Paul Y. Davis, filed the appeal in the United States District Court of Appeals in Chicago, citing that newly discovered

the 1939 case. Mr. Caughran said today. that he would point out in his brief tha

by the U. S. Supreme Court. Mr. Kortepeter, who was to begin his 18-month prison term today, has been granted a 10-day stay of execution pending the appeal.
