This is the season when the country’s film critics, jointly and _severally, burrow into their store of accumulated memories and come “up with their selection of the year’s 10 best pictures. i 1 suspect that the movie public is still more interested in the latest picture of the Hardy Family series than it is in this annual

Even though movie making is, in the main, an assemply line procedure; even though :most of the patrons ask nothing ‘more than routine entertainment, ‘She film medium continues to at4ract sincere and gifted artists. And it con“tinues to draw apart and stand ‘on its own feet as an eloquent .and tremendously influential art. “ The year 1940 started off like ‘as, house afire, and the first six ‘months gave us prcbably more distinguished pictures than in any comparable period in Hollywood history. This is quite remarkable, for it was a tough year for the picture people. The war squeezed down on the foreign market until about 40 per cent of their gross revenue was ‘cut off. The indus- ' try’s position in the scheme of national policy and defense was unclear. The election diverted

IN SPITE OF IT ALL, how ever, 1940 was a year in which a considerable pride is justified. And from its bountiful harvest, this department picks the following as the year’s choice items: + 1, “The Grapes of Wrath”— because its makers dared tackle a bitter and provocative subject,
and because they translated a
book of uneven merit into a pic-
ture of simple, rugged Dower: consummately directed and flaw-
lessly acted. Hollywood . never
produced a film anything like this one, and may never do it again. 2. “Pinocchio” — because Walt Disney is a genius who has contributed something entirely new to the catalog of the arts, through a warmly and universally human sense of humor and a technical skill that beggars praise. 3. “Abe Lincoln in Illinois”— after many tries, the screen finally created a sympathetic, moving and three-dimensional portrait of the most beloved American, thanks to Robert E. Sherwood’s excellent play and the memorable perform= ance by Raymond Massey. 4. “Rebecca”—a tour de force of direction by Alfred Hitchcock which resulted in the year’s most absorbing melodrama. 5. “Gone With the Wind”—because, in spite -of too much bal-" lyhoo and too many feet of film, it was a colorful, lavish, eye-fill-ing and satisfying film narrative. 6. “The Long Voyage Home’ — John Ford, the man who directed “The Grapes of Wrath,” here took some sketchy material and, by his magic, produced the most atmospheric and subtle screen story since “The Informer.” 7." “Ninotchka”—because Holly=wood not only dared to look at communism, but to laugh at it, and because Greta Garbo turned out to be a swell comedienne. 8. “Of Mice and Men”—a tender ht of tortured people, told without pussyfooting or soft soap; a rare and shining example of unpretentious honesty. 9. “Foreign Correspondent’— Jin which Mr. Hitchcock did it again; the year’s prize for forthrll, literate excitement. “The Great Dictator’—be- = Chaplin is still Chaplin, with “his inspired foolery barely triumphing over an ending which all but spoiled the whole effect for many of us. Since the limit of 10-is arbitrary as well as traditional, I'm going ‘to tack on an honorable mention list, some of which probably could be transferred to the upper bracket with a minimum of argument: “Our Town,” “The Primrose Path,” “His Girl Friday,” The Great McGinty,” “The Biscuit Eater,” “The Letter,” “Pride and Prejudice,” “Dr. Ehrlich’s Magic Bullet,” ‘The Shop Around the Corner,” “All This, and Heaven Too.”

Franklin Is Hero of Play
He's Nistehinaler, Too, in "High as a Kite.’
Benjamin Franklin will tread the stage of the Murat tonight not as inventor or diplomat or philosopher, but as a matchmaker. This will be in his capacity of hero of “High As a Kite,” the current offering of the University of Pennsylvania’s Mask and Wig Club. This year marks the 200th ‘anni-
ing. And since Franklin was one of the founders, the least the undergraduates could do was to build their annual show around him. In the book of Louis DeV. Day Jr., Sidney Werteimer Jr. and John C. "Parry, Franklin turns his intelligence and ingenuity to furthering the matrimonial hopes of one Abigail Dinglebender, the sister of his ward. The show’s musical score again is by Dr. Clay Boland, class of ’26, who has done the tunes for Mask and Wig productions for several years. A dentist by profession, Dr. Boland has found time to turn out such hit tunes as (Stop, It’s Wonderful” and: “Stop Beatin’ ‘Round the Mulberry Bush,’ 2 Included in the company of 41 will be one Hoosier, Roger Stanz, a sophomore of South Bend. He's a “girl” in the dancing chorus. The show’s engagement here is for one night only, and is sponsored by the university's Indianapolis alumni association.
SUES TO GET TITLE - OF POWER'S HOME
HOLLYWOOD, Dec. 27 (U. P.) — Tyrone Power is facing a suit designed to deprive him of any legal interest ‘he may claim in a $60,000 home in which he lived while under the guardianship of Attorney Francis D. Adams. The suit was filed by Mrs. Gertrude B. Adams, divorced wife of the lawyer. She asked a clear title to the property, -and her lawyers attached it on the contention it was given her in her divorce settlement. Mr. Adams already had on file against the actor a manager's suit for $230,000, and Mr. Power is asking an accounting (of the funds Mr.
Adams handled.

Argentina Bans 'Nazi Spy’ Film
BUENOS AIRES, Dec. 27 (U. P.). —The Buenos Aires Municipal Motion Picture Advisory Commission has prohibited the exhibition of the film, “Confessions of a Nazi Spy” on the ground that it was injurious to a nation with which Argentina maintains friendly diplomatic relations. The opening of the film had been set for today. The commission said

Westerns not only provide moviegoers with a simple and unvarying fare, but they also provide Republic Studios with its bread and butter. In “Melody Ranch,” however, Republic has added some unusual side dishes. The picture, which is at the Ambassador through Tuesday, has Gene Autry, which is natural and usual. But it also has Ann Miller, the cute
that explosive] and proboscidate: comedian, J Durante. Seeing these Broadway fugitives in a mustang melodrama is just like finding an automat in Death Valley. It just ain’t possible. Yet there they are. And you haven't heard the half of it yet. The stalwart Mr. Autry actually gets knocked down and beat up by a couple of the villains. (This, however, is because he’s been traipsing around the country, crooning on the radio instead of punching cattle and keeping in shape.) Mr. Autry also kisses the heroine. She has to propose first, of course. And the actual osculation is shown only by in_. ference, since the shock of such sissy goings-on would surely prove too much for Mr. Autry’s youthful admirers, Republic seems to have spent a good: deal of money and some extra pains on “Melody Ranch.” But don’t think for a minute that it has poked fun at the sacred institution of the horse opera. may dispense his own particular brand of urban humor, and Miss Miller may dance as if there were
