BRIDGE BOARD ~ TO FIGHT SUIT
‘Want Legal Questions Cleared Up,” Says Span Chairman.
The Indiana Toll Bridge Commission will fight the injunction suit against the purchase of the New Harmony Toll Bridge “through all the courts,” William G. Minor; Cannelton, Commission chairman, said today. “We want to get the legal question concerning this bridge cleared up-erice and for all even though it means that the present plans for sale of bonds and purchase of the bridge cannot go through,” Mr. Minor said. The Commission had planned to buy the bridge: for $945,000, obtaining funds through" ‘sells, of the $1,050,000 bond issue. The two Chicago’ firms which submitted. successful bids on the bond issue declared that they would not go through with the deal unless legal action against the transaction was dropped by Dec. 24..

The suit alleges that the bridge purchase price is excessive. Mr. Minor said that after the matter is cleared up in the -courts, the Commission can then formulate plans to buy the bridge, which he says is a good investment. Commission ‘members conferred for a short time today on the matter with Gov. Townsend.

CITE BALL SALE. OF RAIL STOCK
Sentors Say Alleghany Deal Shows Need of Legislation.
WASHINGTON, Dec. 20 (U. > 3 — Two members of a Senate state Commerce subcommit ported today that Robert R. New York stock broker, ac , i control of the $3,000,000,000 | Alleghany Corp. with $254,295. Senators Burton K. Wheeler (D. Mont.) and Harry S. Truman (D. Ball Transferred Control
In the transaction, George Ball, Muncie, Ind., glass jar manufacturer, transferred control of Alleghany to Mr. Young. The manner of this transaction emphasized the need for legislation against holing company control of railroads, Mr Wheeler and Mr. Truman said. Mr. Young’s two associates in the purchase were Frank F. Kolbe, former assistant treasurer of General Motors _Corp., and Allen P. Kirby, Wilkes-Barre, Pa. according to the subcommittee. Between them, Mr. Wheeler and Mr. Truman continyed, the three assumed control’of Alleghany for a cash outlay of $1,500,000, of which Mr. Young, who arranged the deal, contributed $254,295, hut received controlling interest. Top Holding Company The Alleghany Corp. was the top holding company of the late Van Sweringen Brothers of Cleveland, who built the nation’s largest railroad empire, which became involved in financial difficulties and collapsed in 1935.
