- Some idea of what radio music will be like if ASCAP and the networks fail to reach an agreement ‘may be obtained tonight on the Lanny Ross program, 6:15 WFBM. Lanny will sing only ones in the public domain or those published by BMI, the be own song source. In other words, music controlled by ASCAP will be out, for this performance at least. An unusual angle so far as Lanny is concerned is that the melody of his theme song, © “Moonlight ‘and Roses” is regarded as part of the public domain but ' the lyrics are controlled by ASCAP. Just what Mr. Ross will do about
“Practically all popular music, running a melodic gamut from Victor Herbert to Irving Berlin, will be barred from radio when agreement terminates,” Mr. Hummert wrote. “That will be the outcome of a slow musical depression, which American listeners are already beginning to suffer now. “Millions of Americans have no idea of the seriousness of this situation which now throws a barbed wire fence about the songs we have come to take for granted. . . . “I believe that both ASCAP and the broadcasters feel strongly and Sincerely about alleged. grievances. But I believe, too, that a Federal agency operating for American good, should act as a mediary and effect a settlement. The issue is important enough to demand prompt and decisive action,” he concludes. Chief point in the dispute is ASCAP’s demand for 7% per cent of the networks’ total income from time sales. Until now networks have not paid anything, the individual stations bearing ' the entire cost. Estimates at the new rate would doublés-ASCAP’s present $4,000,000 annual return from radio.
