Old Songs Launch New Quarrels Over Royalties

Baker tapped the mother lode of voice resurrected “Oh Johnny, Oh,”
and created a national musical nostalgia, The songs that a few oldsters were humming in the shower now are crowding air waves, selling scores of thousands of phonograph records

dollar bill it would cost to renew them for a second 28-year lifetime. Only the United States Supreme Court, in all probability, can determine beyond dispute who owns the renewal rights on some of these copyrights—whether the veterans of Tin Pan Alley, who originally tapped out the melodies and rhymed the lyrics, or the corporate publishing houses to which the copyrights were assigned many years ago. A number of suits are pending, in various stages, in the Federal courts. Of these the most interesting, and perhaps the most important, is that in which the publishing house of Shapiro, Berstein & Co. is trying to. restrain Fred Fisher and Al Bryan from selling to Fisher's own publishing house, Fred Fisher & Co., and to the Famous Music Co., the renewal copyrights to that bright little thing called “Come, Josephine, in My Flying Machine.” Al Bryan wrote the words to fit a waltz melody by Fred Fisher, which now has been transformed into a fox trot and has become a property of value. When they wrote Josephine and many other once popular songs which have been revived already or are being plugged for revival, Fisher and Bryan were under contract to the late Maurice Shapiro to write only for him, in return for which they were promised a royalty of three-quarters of a cent for each piano-forte copy sold, plus quarter of the royalties from music rolls and other recordings, against which they were to draw $35 each as advance royalties every week. Shapiro, Bernstein & Co. who now own Shapiro's interest, assert that Fisher and Bryan were working for hire when they wrote Josephine, and that therefore Shapiro, Bernstein had the right to renew the copyright when it expired in 1937. Fisher and Bryan claim that the contract was for royalties, and was not an employment contract in the sense contemplated by Congress when it amended the copyright law in 1909. So they, too, have applied for renewal, and have sold the renewal rights. The outcome of this suit will affect a large, if incalculable, total of royalties over a period limited only by the duration of the current craze for revivals, for Fred Fisher has some justice behind his claim that he has poduced “the biggest routine of any song writer outside of Berlin and Kern.” And Bryan was his collaborator in many of the better known. You must remember “Peg of M$ Heart,” “I Love You” and “Any Little Girl That's a Nice Little Girl Is the Right Little Girl for Me,” not to mention “There's a Little Bit of Bad in Every Good Dittle Girl” and “Oui, Oui, Marie, Oh You Do Zis for Me.”
