NLRB PROBERS HEAR DISPUTED EXPENSE STORY

Records Conflicting Versions Of New York Trip by Ousted Director.

WASHINGTON, Dec. 18 (U. P.) — The House committee investigating the National Labor Relations Board today put into its record an official NLRB report that James P. Miller, deposed NLRB regional director at Cleveland, told two stories about who paid his expenses on a trip to New York before he was asked to resign. At the insistence of Rep. Abe Murdock (D. Utah) the Committee overruled its counsel, Edmund N. Toland, and put the report into the record. The report was from Robert M. Gates, NLRB investigator. He said Mr. Miller told him on April 7, 1939, that Glenn O. Smith, Cleveland attorney for employers, paid his expenses to a dinner that Mr. Smith gave in New York, but later told the Board that he had reimbursed Mr. Smith in March. Mr. Gates said that ‘in April Mr. Miller had told him he did not know the cost of the dinner or his own expenses.

Explains Resignation

Testifying before the Committee Saturday, Mr. Miller saia he haa repaid Mr. Smith in March, and exhibited two $40 checks drawn to “cash,” out of which he said that he gave Mr. Smith $48. Mr. Miller, now a $150-a-day labor relations consultant in Cleveland, told the Committee Saturday that he had been asked to 1esign because he insisted upon administering the labor law impartially. The Board said he was asked to quit because of “improper conduct.” Resumption of the Labor Board hearing followed announcement by the Congress of Industrial Organizations that it has changed its previous stand and now desires three amendments to the Wagner Labor | Relations Act.

At the same meeting, the Commissioners awarded contracts for approximately $60,000 worth of stationery, printing and election supplies for next year to three low | bidders. They were the W. B.
