CAREFUL STUDY Silent Work o DROMISED IN

CITY GAS MOVE

Ordinance on Condemnation Of Property to Be Scanned By Council Monday.

City officials today promised a

thorough study before Council takes any action on the proposed condemnation of gas mains and other property of the Indianapolis Gas Co Directors and trustees of the Citizens Gas & Coke Utility vesterdav adopted condemnation resolutions as the first step to acquire complete ownership of the gas distribution system. The next step in the plan will be the introduction of an ordinance at the Council meeting Monday actually condemning the property and directing the Utility directors to take “further additional necessary steps.” Public Wearing Probable

These would be the filing of a suit in a local court asking ‘the court to fix a fair price to be paid for the property. Council President Joseph G. Wood declared the Council would take its time in considering the proposal, and added that a public hearing probably would be held.

Other councilmen promised care-

ful consideration. Harmon A. Campbell, Republican said he thought most citizens believed the City acquired the entire gas distribution system when it bought the Citizens Gas Co. in 1935. Mr, Campbell said he knew ndianapolis ‘Gas owned part of the mains, but didn't realize the company owned more than hall those used by the City utility. Councilman Ernest Rapkev, Dem ocrat, said he was unaware that part of the mains were not awmed hy the City, and added that he would insi on the Council “taking its time” in the matter.

Ruling Appealed

Decision to actuire the Tndianapolis Gas Co. property. which had been operated by the Citizens Gas Co. under lease since 1918, was reached after the City won a Federal Court ruling several months ago, after three years of litigation, that

the City was not bound by the 99.

vear lease executed in 1913. The ruling has been appealed. Since it bought the Citizens Gas Co. property in 1935, the Utility has continued to use the Indianapolis Gas Co. property under an agreement whereby the City paid the lease rental to a bank to be held in escrow pending final settlement of the dispute over the lease. The Indianapolis Gas Co. owns slightly more than half of the mains used bv the Utility. IT the Indianapolis Gas property is not condemned, the City is faced with the alternative af negotiating 2 hew lease an the property, or abandoning gas Service in some sec. tions of the City,
