Hatch Law, intended to - divorce the Federal executive personnel from active ‘participation in party politics, were worried today about Attorney General Frank Murphy's handling of two of the most important cases that have come up under the new statute. They feared the Attorney General ‘has weakened from his expressed intention. of enforcing the law “up to the hilt”—particularly in the Justice Department, which he declared must not be suspected of itself winking at violations of the statutes in its care. e verdict as to whether Mr. Murphy actually has weakened was withheld until the complete text of his letter covering the two important cases can be obtained.

District Attorney Candidate

The U. S. District Attorney in Pittsburgh, Charles F. Uhl, and his’ assistant, John ‘D. Ray, both are candidates for state offices in the September primary. Mr. Murphy has held both officials subject to the Hatch Law, and has indicated his agreement with a statement by the statute’s author, Senator Carl A. Hatch (D. N. M.), that “any Federal official subject to this act, who is a candidate for another political office, should forthwith resign or .abandon his candidacy.” One official has presented his resignation and the other has offered to resign. But the Attorney General, after several days of study, said he would have to consider whether the public interest would be served best by requiring the immediate resignation of both officigls, or whetker it would be desirable to keep one or + both in their present offices so that the work of the Federal District Attorney in Western Pennsylvania can be carried forward.

Extreme Application Avoided “While it is our plain duty as public officials to give the law (the Hatch Act) an honest, just interpretation, it is also our duty to avoid an extreme application that would needlessly prejudice or "interfere with the proper conduct of the business of this office,” Edward G. Kemp, Mr. Murphy’s assistant, said in a letter to Mr. Uhl Messrs. Uhl and Ray were informed that their resignations would not be immediately required.
