AUTO REPORTS INDICATE 1938 LULL IS GONE

Association Says Sales 58 Per Cent Advanced Over Last Year.

DETROIT, April 19 (U. P.).—The automobile industry, usually a reliable barometer of general business trends, definitely has pulled itself out of the doldrums of 1938, a survey of comparative reports indicated today. Automotive manufacturers, however, do not anticipate an unusual spring sales boom. The Automobile Manufacturers Association reported that factory sales of automobiles and trucks in the United States and Canada during the first quarter of 1939 were 58 per cent greater than in the corresponding period of 1938. Manufacturers produced 1.055.787 cars and trucks during the first three months of this vear as compared with 668,346 last year. Buick Reports Record The most glowing sales reports| have come from Buick. W. F. Hufstader, sales manager, said sales in| the first quarter of 1938 were the| greatest in the company’s history. | Buick delivered 46,675 cars during the first three months, breaking the| old record of 44,935 cars sold during the corresponding period in 1926. | Chevrolet retail sales in March | were the highest in 18 months. This] General Motors division made a| gain of 41.2 per cent over March of | 1938. C. P. Simpson, Pontiac sales manager, said that in the last 10 days of March his company sold 40 per cent more cars than during the same period of 1938. : Oldsmobiie built approximately 100,000 cars during the last three months—as many as were built during the entire 1938 model year. ‘48 Per Cent Higher’ “Our sales for March were 48 per cent higher than last year,” D. E. Ralston, sales manager, said. Cadillac-LaSalle spring sales during the final 10 days of March were the best for such a period in 20 months, Sales Manager D. E. Ahrens said. Death by Reckless Driving Will Be Prosecuted as Such, Stiver Writes.

STIVER State Director of Public Safely A new traffic charge to be known as “reckless homicide” under a new section of the 1939 State Safety Code, will result in getting more convictions in cases involving deaths, The new charge will be used for traffic cases instead of involuntary m & ns laughter which has prevented convictions because of its heavy penalty and because juries often confused the charge with murder. Under t he n e w reckless homicide section of ‘the traffic laws, judges and juries may impose only a fine as low as $100 Mr. Stiver up to $1000 or imprisonment of not less than 60 days nor more than six months. The maximum sentence under the section, in extreme cases, would be one to five years. All traffic cases involving deaths in the past have been prosecuted under the involuntary manslaughter act which provides a penalty of one to 10 years imprisonment. Juries and judges have hesitated to convict motorists under this law when circumstances and driving conditions mitigated the offense. Motorists will be charged with reckless homicide in the future where evidence shows a person was killed under circumstances of reckless driving.

GC TO PROBE RULES ON AUTO SHIPMENTS

Times Special WASHINGTON, April 19.—A na-tion-wide investigation of all rates and regulations on interstate shipment of new automobiles is to begin

when the Interstate Commerce Commission opens hearings June 13 at Chicago. Water shipments rates will be investigated simultaneously by the Maritime Commission. The investigation was requested by the National Automobile Transporters Association, Inc, which charged railroads, in filing reduced automobile rates, had begun a rate war that would hurt the public. The Association, a division of the American Trucking Association, said automobile transporters feared the new rates “will result in forcing them out of business.” The ICC said major automobile manufacturers had promised co-op-eration at the hearings which will embrace ‘all rates, charges, rules, regulations and practices subject to the interstate commerce act, affecting interstate transportation of new automobiles, whether by rail in carloads, or by haul-away, driveaway or tow-away methods, or by any of those methods in conjunction with water carriers.”

Indiana, Wisconsin Control Only Adequate Systems, Survey Says.

An Editorial Research Report released today said that only Indiana and Wisconsin regulate automobile finance companies in & manner considered adequate. Indiana is the only state which sets maximum rates companies can charge, according to Homer O. Stone of the State Department of Financial Institutions. Unfair practices of some finance companies forced Indiana to pass this legislation in 1935, Mr, Stone said, “We launched an investigation of finance companies in 1933 under the McNutt administration,” Mr. Stone said, “which proved conclusively to us that something must be done to protect the car buyer.” “After our gegulatory statutes were passed they were challenged and ruled unconstitutional by the Federal Court at South Bend. “The U: 8. Supreme Court reversed that decision and said that the power of the ultimate decision lies with the Indiana Supreme Court.” “There are 416 finance companies under license in Indiana at present,” Mr, Stone said. / Under rates set by the state a car costing approximately $600 could bring a minimum interest rate charge of 6 per cent or the maximum rate of 24 per cent.
