But on the other hand, if the test
showed a driver's body to have a
blood alcohol content of between

considered relevant evidence for use
when the symptons warrant prosecution, but not conclusive evidence that the driver is entirely under the influence of intoxicants. In this alcohol content zone, the evidence would intend to show that the driver had consumed from three to six ounces of whisky. This additional evidence is often sorely needed as
the usual alibi is that the driver had
but “one or two glasses of beer.” Tests showing a driver's content is .15 per cent or abcve usually means that he has consumed more than one-half a pint of whisky and

EEKLY wages of autombile factory workers averaged $31.35 in January this year, compared with $25.15 in the same month in 1938, the Automobile Manufacturers Association reports. Work hours per week averaged 34 against 2714 during the same period last year. Hourly rates of pay increased a half cent over the 92 cent figure, according to the U. S. Bureau of Labor Statistics.

the statutory definitions of the of- :
fenses. Studies made in various parts of the world and covering observations upon more than 10000 individuals show that 100 per cent of persons have their driving ability impaired with this concentration of blood alcohol. Other Tests Possible
The law does nol require use of |’
the drunkometer test exclusively. Blood, urin or breath tests may be used. The drunkometer, which computes the blood alcohol content from the breath, is most convenient to use. The tests will result in a much higher proportion of guilty pleas in the courts and a higher percentage of convictions in cases which go to trial. The conditions surrounding an automobile accident frequently make it difficult to obtain reliable information relative to sobriety, since the person in the accident may behave abnormally, even when he has not been drinking. The tests have been used to exonerate motorists who behave abnormally but who had not been drinking or had been drinking very little.
