8,0.P, DEFEATS MOVE TO ALTER INQUIRY SETUP

Democrats Fail to Have Bill ~ Offered to Senate: for Concurrence.

" House Republicans today deisated; 50 to 47, an attempt to change the form of the Evans investigating resolution despite a warning by Democratic leaders that this measure, which calls for a probe of all State

- and local governmental units, has

“no force.” This contention was sustained in part by Speaker James Knapp, a Republican, who pointed out that the House resolution passed yesterday “was weak in that it carries no appropriation and no one would undertake this task without funds.” The resolution, passed by the Republican House with heavy support

Under the free text book bill, which was passed, 71 to 6, school authorities would purchase . free books for grades one, two and nine in 1940-41; three, four and 10 in 1941-42; five, six and 11 in 1942-43; and seven eight and 12 in 1943-44. House Kills Senate

Nepotism Measure

By accepting a report of its Judiciary “B” Committee, the House today killed a Senate concurrent

resolution which would have required all State and local governmental officials to present the Legis-

lature with a list of relatives on public payrolls. The committee alfoan, Rep. George W. Henley (R. Bloomington), explained that the House did not receive this measure until Feb. 13, the date the list was to “have been submitted. Final House action was taken on a voice vote and without debate. The nepotism issue produced a sharp fight in the Senate. ‘ Republican Senators originally introduced a resolution to apply only to State officials. Democrats substituted and passed a new resolution which would have included local officials in the list persons required to report.

cratic administration. It also was empowered to delve into any county government, presumably those controlled by Democrats in which Republicans charged vote frauds in - the November election. The Democratic floor leader, Rep. Edward H. Stein (D. Bloomfield), reopened the argument this morn‘ing when he moved that the Evans House resolution be withdrawn and & new joint resolution calling for an investigation of State government back to Jan. 1, 1924, be introduced and passed. Republican opposition to this move was led by Rep. Herbert H. Evans (R. Newcastle), the author of the resolution which passed yesterday, and Rep. Paul S. Brady (R. Muncie) pointed out that an act of 1937 enabled either house of the Legislature to - conduct investigations and subpena witnesses and Tecords. ‘Denton Raises Question, This contention was denied by Rep. Winfield K. Denton (D. Evansville), who said this statute applied only to investigations conducted while the Legislature was in session and “not to fishing and smelling expeditions organized after adjourn- " ment.” Claiming that a House resolution, which does not require Senate action, could not be considered as binding, Rep. Stein in his motion asked Rep. Evans to introduce a Joint resolution. The suggested committee would be composed of six Republican and six Democratic legislators divided equally between the two houses. “Now, please, if you Republicans really want to conduct an investigation, vote for my motion and withdraw this first resolution and pass a joint resolution, which would have the full force and effect of law,” Rep. Stein said. -“If this isn’t done, I warn you, it will be impossible for you to have this probe.” Rep. Evans charged that G. O. P. representatives ‘repeatedly have tried to find facts regarding the State Administration but have been blocked every time by the-minority.” Denied by Democrats This was denied By Democrats, who repeated their Pri to support any investigation. : The unsuccessful motion of Rep. Stein challenged the sincerity of the Evans resolution since the latter was in the form of a House instead of a joint resolution. The Stein motion said in part: “Rep. H. H. Evans as an old and experienced legislator, no doubt does and should know that a mere House resolution cannot confer such powers on any committee and that a resolution passed by one branch of the Assembly only, is of abso- - lutely no force and effect after the session is ended. - “Since it: is difficult to believe that Rep. Evans is sincere in his eagerness to investigate the Democratic State Administration, or he would have introduced a joint resoJution, which when passed would have conferred the powers which he allegedly wishes to bestow on the treat.
