U.S. GOURT BACKS SOLVENCY REPORT
WHEELING, W. Va,, Feb. 1 (U. P.).—Federal Judge William BE. Baker refused the appointment of a receivership for the 36-million dollar Fidelity Investment Association as he confirmed a special master’s report which found the firm solvent and recommended dismissal of receivership proceedings. ' Judge Baker denied the request for receivership, made . originally Dec. 9 by nine Philadelphia contract holders of the investment loan firm, after studying the 56-page report that Special Master Charles P. Mead made to the court last Thursday. As Judge Baker sustained Mead’s report, he overruled an exception filed by Edward Lamb, attorney for Alice P. Hutchinson, Toledo contract holder, who, as an intervenor, ob‘jected to Mead’s report because solcy was determined by “sound” than market value.

BOWMAN AWAITS REMOVAL
FT. WORTH, Tex, Feb. 1 (U. P.). —Howard C. Bowman, 29, escaped Ohio State Penitentiary convict, today awaited authorities from Columbus, O., who will take him back to the prison from which ‘he fled Jan. 17. He waived extradition. Bowman was captured here yesterday after police had received a tip from El Paso and Odessa, Tex, authorities.

Gisler Rejoins Park Board—Albert H. Gisler, Park Board member during the administration of former Mayor John W. Kern, was appointed yesterday to the board by Mayor Sullivan. He succeeds E. W. Dorn, whose! term expired.
George T. Whelden, real estate broker, was appointed by Mayor Sullivan to the City Plan Commission and Board of Zoning Appeals. Mr. Gisler, president of Kothe, Wells and Bauer, wholesale grocers, lives at 5139 E. Michigan St. Mr. Whelden, 2128 N. Alabama St., will begin his second terin as Plan Commission member. Appointment of ‘George PF. Rooker, for 14 years draftsman and later thoroughfare engineer for the city, as secretary- engineer of the City Plan Commission also was announced. | Mr. Rooker succeeds Val B. McLeay who was appointed assistant City engineer. In making the appointment Mayor Sullivan said that he chose Mr. Rooker ‘for his long and meritorious service with the City.” Mr. Rooker lives at 1210 N. Drexel Ave. and began his service with the City shortly after leaving Purdue University. {

WASHINGTON, Feb. 1 (U. P.).— President IL. M. Giannini of the Bank of America said today the bank would appeal to the Supreme
Court if necessary from district court desmissal of its petition. for an injunction to prevent the Securities and Exchange Commission rom making its records public. U. S. District Judge: Daniel W. O'Donoghue yesterday refused to exclude the Bank of America from the SEC’s case involving the stock of the bank and its parent company, Transamerica Corp. The decision denied the bank’s contention that it would be done “irreparable damage” by public presentation of its records.

ROOSEVELT 3 TERM FAVORED BY BRITONS
Think World Would Benefit, Gallup Poll Discloses.

NEW YORK, Feb. 1.—British public opinion handed President Roosevelt a belated birthday bouquet today. In a. cross-section survey conducted by the British “Institute of Public Opinion, which the London News Chronicle publishes today, the overwhelming majority of British voters interviewed said they thought the “world would benefit” if President Roosevelt were elected for a third term. ‘What Britishers think of President Roosevelt makes scant difference on election da, of course, and the President has not indicated that he is thinking of seeking a third term. But the survey is significant as probably the first test of his popularity outside the United States. American opinion has been sharply opposed to a third term for Mr. Roosevelt, according to survey of the American Institute of Public Opinion, of which Dr. George Gallup is director. Here is the actual vote in the survey which the Institute’s British affiliate has just conducted, however: Believe world would benefit if Roosevelt were re-elected; 91%. _ Believe world would not benefit, 9%.

The corporation stated $1,317,787 would be distributed throughout the country under the provisions of the Employees’ Savings and Investment Plan. The corporation contributed $591,847 and employees paid in $725,940, it was announced. » Company employees in Anderson were to receive $62,539.39, and employees in Muncie $834.32.
