WEIGH APPEALS IN FRAUD CASE
Three ~ Continental Credit Defendants Undecided On Action.
Three defendants under sentence in Federal Court in the Continental Credit Corp. mail fraud case, today were undecided whether to file appeals from their convictions. Two other defendants, John W. Moore Sr. and his son, John W. Moore Jr., under sentence of seven and five years, respectively, filed notice in| Federal Court yesterday that they would appeal to the U. S. Circuit Court of Appealsat Chicago. In the appeal notices, filed by Clinton H. Given, attorney for the Moores, 12 grounds were set out charging error by the court and insufficient evidence to warrant convictions. The notices said the court had erred in overruling a motion for arrested judgment filed. in both cases and in refusing to direct a verdict for the defendants. The notices asserted further that the District Attorney failed to prove allegations concerning filing of a bankruptcy- petition in Buffalo in 1935 by John W. Moore Sr. and that the allegations “had no bearing on the guilt or innocence of either defendant.” Both the Moores and the three others convicted are at liberty under $15,000 bond until Tuesday, the deadline for serving - notice of appeal.
