APPEALS COURT SCOPE DEFINED

Supreme Tribunal’s Opinion Denies Petition in Lien Foreclosure~Suit.

The Indiana Supreme Court had issued a statement of policy today recognizing that the Appellate Court has “broad powers and discretions” to determine what questions are involved in a case and how complete an opinion is necessary. The statement was given in an opinion denying the petition of Anna E. Sluss, who asked that the high court mandate the Appellate Court to grant an appeal in a lien foreclosure suit. She contended that the Appellate Court had not properly answered all the questions in the case when it rejected her appeal from the Morgan County Circuit Court last May 10. Pointing out that mandamus actions are extreme remedies provided by law, the Supreme Court said it would not issue them against the Appellate Court unless it believed that justice had been denied the complainant “by failure of the Appellate Court to discuss some question properly presented.”
