The ruling was made in a suit brought recently by Mrs. Mae N. Perry, former wife of Norman A. Perry, Indianapolis businessinan, against the State Treasury Department for a refund of $2100 in taxes paid on a $265,000 alimony judgment three years ago. Judge Wilson held that under the 1933 law alimony was “not within the meaning of the Gross Income Tax Law.” Changes made in the law since it was enacted, however, make alimony subject to taxation. The tax was paid before the law was changed, according to the suit. Unless the ruling is appealed, the State will be required to reimburse Mrs. Perry for the tax.
