licans in all sections of the state rallying to support the recount investigation, which is viewed in some quarters as a curtain-raiser for the Republican campaign in 1940. Meanwhile, it was disclosed in high official sources today that Raymond E. Willis, defeated G. O. P. . Senatorial nominee, may file a separate recount petition in the Vigo County Circuit Court.

Noel Neal, former Appellate Court Judge, who was Mr. Willis’ campaign manager, said such action had been contemplated, but had not been decided on definitely to his knowledge.

The Marion County Republican Committee, pressing its investigation, announced today that hundreds of affidavits charging election irregularities in the County, were being investigated. County leaders, however, refused to reveal the nature of the alleged irregularities. While the legal procedure to be adopted in the recount was not disclosed, it was assumed that -each candidate would file a separate petition in the Circuit Court of each county where the vote is to be con- * tested. The petitions, however, would be based on the same set of allegations. These allegations so far have not been revealed. All but three or ihe candidates on the State Repu ticket are expected to file hy Claims Tucker Election

Republicans now claim the election of James M. Tucker as Secretary of State, and Mr. Flanagan and Mr. Durre as Appellate Court Judges, on the basis of unofficial returns. Whether the official vote will affect the recount investigations re- " mained subject for speculation. The Repubican State Committee is demanding the recounts on the basis of their own figures, which may or may not coincide with the official count. Election officials taking the canvass said that figures were not official. All tabulations will be rechecked. by the election deputies and checked a third time by accountants for the State Board of Accounts. William P. Cosgrove, chief ex-! aminer for the board, said yesterday that he would lend his accountants to the election deputies but he could not assume responsibility for the accuracy of the count. The tabulations of 82 counties for major State offices and for U. S. Senator were:

LAWYERS PREPARE FOR VOTING CASES

Defense Will Seek to Quash 16 Indictments.

Legal machinery was expected to be set in motion this week in the cases of 92 primary election workers

charged with violating Indiana election laws. - Defense attorneys said they were preparing motions asking that the 16 indictments returned by the Grand Jury in the cases be quashed on the ground of “insufficient evidence.” The motions, attorneys said, probably will be filed Friday or Saturday. Circuit Court Judge John W. Spencer Jr. of Evansyille, special judge-in the cases, has set Nov. 25 for arguments on all motions and for arraignment of defendants. Defense attorneys said that if their motions to quash are overruled they will be prepared to file pleas in abatement. . The indictments were returned six weeks ago after the Grand Jury had investigated primary election irregularities®for mare than three months. | The investigation followed dis1 [closures of discrepancies during a recount of primary ballots in the Democratic sheriff race.

qualified to inflict the death penalty. But the child’s testimony may send her father to prison for a term ranging from 14 years to life. He is accused of having murdered his wife, Marguerite, 37, with a rifle in their home Oct. 1. The child told her story reluctantly in Judge Jerome Dunne’s courtroom yesterday, pausing frequently to keep back the tears. She was excused once to weep in an anteroom.. She had greeted her-fa-ther with hugs and kisses when he was brought into court. Her testimony concluded, she ran sobbing into his arms. He hugged her for a moment and asked: “Youre still daddy's little girl, aren't you?” “Yes, yes, daddy,” she answered, “I am.”

Shy and Reluctant

She had been shy and reluctant to climb into the witness - chair. Prosecutor John Boyle assisted her and she seated herself, peering out from a brown bonnet with a bow tied under her chin. Under Mr. Boyle’s questioning, she said she knew it was wrong for little girls to lie, but she said she didn‘t know what happened to those who did. She said she heard her father and mother quarreling the night of the shooting.

Dunne asked the question again. “What did your mother say?” he asked. “She said, ‘Please don’t shoot me, Jim,” ” Martha Jean answered, bowing her head. She added quickly: “But she might have said, ‘Please don’t shout, Jim.”

Heard “Loud Noise”

She said she heard a “loud noise” a few minutes later but could not describe what it sounded like. She and her brothers, James, 4, and Robert, 2, were in bed when she heard the noise. She said she ran into the next room and saw her mother lying on the bed, a wound under her left breast. . The gun lay at the foot of the bed. “Daddy told me there had been a terrible accident—that mother had shot herself.” “What happened then?” Mr. Boyle asked. “Daddy wiped off the gun and I

put it in a closet. I guess he told me to.”
