The Monticello Manufacturing o. of Elwood has been ordered to make ineffective a contract with fhe Federal Labor Union 25178, an A. F. of L. affiliate, Robert H. Cowan National Labor Relations 0 regional director, said today. & The company also has been asked “rehire 16 men who were disgharged when the contract went into Effect and to give them back pay. Trial Examiner Refuses to Reconsider Ruling.

: PITTSBURGH, Nov. 10 (U. P.)— James C. Batten, National Labor Relations Board trial examiner, to@ay had refused to reconsider his ruling which struck large blocks of testimony in the 15-month-old Weirton Steel Co. case and cleared the

way for action on the company’s request for dismissal of the dis¢rimination charges of 49 of 132 complaining workers. . Isadore Polier, attorney for the NLRB, presented a 42-page motion to Examiner Batten in which he contended the order was ambiguous and should be withdrawn. “The order is final,” Mr. Batten fold Mr. Polier, “except I will attempt to clarify it from time to time. But I will not reconsider ny order as a whole.” “The ruling in question struck from the 32,000-page record all testi- . many in regard to political cam‘paigns; all testimony in regard to & strike at the Weirton, W. Va, plant in 1933 except where directly gonnected with the- discharge of a worker; testimony as to discrders which occurred on the company's property unless an agent of the company was involved, and statements as to arrest or indictment of employees intended to impeach testimony of a witness. The order was handed down in Washington last Oct. 29.
