When informed that Utah’s capital punishment law gave him a choice of being hanged or shot by a firing squad, Deering replied: “I'm no good, anyway. I want to get it over with the quickest way possible. I'll take the firing squad.”

Returned to Salt Lake City, Deering attempted to plead guilty, but his plea was refused and he was forced to stand trial on first degree murder charges. The trial was brief, marked by a violent outburst from Deering when he protested against Meredith's aged widow being required to testify.
