Chief, Judges Map New Plan To Prosecute Drivers For Drunkenness.
Three persons were recovering today from injuries received when their car overturned three times in the 6300 block on S. Meridian St. yesterday. ‘Manual High School football . players aided in rescuing them from the wrecked car. The injured were George Mitchell, 57, of 1202 N. Capitol Ave.; his wife, Mary, 52, andtheir daughter, Elizabeth, 32. They were taken to St. Vincent's Hospital. According to Sheriff's deputies Mr. Mitchell said his daughter was driving south about 40 miles per hour when the car went out of control. Mr. Mitchell said he broke . the windshield to get out of the car and pulled his wife after him. His daughter was pinned under the auto, and the Manual High reserve team, en route from a Southport football game, stopped and team members helped lift the car to get her out. The Manual players bound the wounds of the victims and resuscitated the women who were unconscious. After they had given first aid, they called the Sheriff's office and stayed at the scene until ambulances had taken the injured away. Charles Roesene, 63, of 537 N. Hamilton Ave. received a broken leg and head cuts when he was struck by an auto on New York St. near Hamilton Ave. last night. Seven other persons were injured, none seriously, in five other auto accidents reported overnight. Pohe made 23 traffic arrests, including five alleged speeders.
Chief, Judges Draw New Plan on Drunken Drivers
In an effort to increase the number of convictions in«drunken driving cases, Chief Morrissey and Municipal judges today agreed on a procedure to be followed-by both police and the courts in arrests and trials in such cases. The action followed a meeting of the Chief and judges yesterday. Under the agreement, police will continue to make arrests at the scene of accidents on drunken driving charges on information of witnesses even though the offense, legally a misdemeanor, was not committed in the officer's presence. The law covering misdemeanors does not provide for the arrest of accused persons when the officer is not a witness.

Chief Morrissey and Municipal Court Judge Charles J. Karabell said today the reason for agreeing to arrests without affidavits was two-fold: 1. To force reluctant witnesses to testify against drunken drivers. 2. To prevent escape of drunken drivers by the setting of high bonds. An affidavit is necessary in order to prosecute offenders, but under the agreed procedure the officer may sign the affidavit himself after an investigation which includes the taking of statements of witnesses, Chief Morrissey said. Witnesses who “are chiefly interested in securing money for damages to their automobiles and not in prosecuting” need not sign affidavits themselves against offenders under the procedure, Judge Karabell said. A bond, considerably higher than that provided for in drunkenness cases, will be placed against the offender to hold him pending the investigation of the accident. Chief Morrissey explained that if the operator were only arrested on a drunkenness charge a bond of only $11 is necessary to be posted pending an investigation into evidence of drunken driving. Because the drunken driving is a considerably more serious misdemeanor in its penalty, offenders would “skip,” the Chief said. The law covering misdemeanors provides that if no officer witnessed the offense, witnesses may sign an affidavit upon which a warrant for arrest is issued. The arrest then is made upon the warrant.

use of new school zone signs on roads is being followed by the State Highway Commission, Hallie Myers, Commission traffic director, reported today. The new signs are on portable tripods which are placed in the middle of roads during school hours. The Commission provides the signs, and they are removed from the roads by school employees after school hours under terms of the contracts which the Commission enters into with the school corporations. “Purpose of the new middle-of-the-road signs is to attract attention of motorists,” Mr. Myers said. “The old school zone signs are along the sides of roads, and because they are immovable they remain as a warning to motorists during hours when school is not in session. “Motorists passing such signs at night become used to them and these signs actually lose their warning effect when pupils are going to and from classes. While the new signs are placed in the middle of the road, they are small, and are not a hazard to traffic.”
