Roads Insist on Cut
The railroads have insisted repeatedly throughout negotiations that the cut is necessary to save * them from bankruptcy. The unions have just as steadfastly refused to accept the reduction.
Arbitration would have been the next step in the machinery set up by the Railway Labor Act of 1922, but, although the carriers were willing, the brotherhoods refused to follow the procedure. Their refusal - ultimately will make it necessary for a Presidential fact-finding commission to investigate the dispute and submit a report. In the meantime the carriers must remain status quo for 30 days.

one-third of the Class I railroads are in bankruptcy, carloadings have been low, and the Interstate Commerce Commission refused id .grant an increase in rates. The unions contend that a wage cut in the railroad industry would precipitate a cycle of wage reductions throughout the country that would defeat present efforts of Congress to stimulate business and restore prosperity. They claim railroad wages are inadequate and below the general average in other American industries. H. A. Enochs, chairman of the Carriers Joint Conference Committee, representing the railroads, said the unions were “afraid to present their case before an impartial tribunal,” and charged that they had timed the negotiations so that a crisis would occur about the time of the November elections. “They want to take advantage of politics,” he said. After the Mediation Board had announced collapse of its efforts, Mr. Enoch came to the door of the conference chamber. He drew a yellow memorandum from his brief case. “The 18 brotherhoods have definitely agreed not to arbitrate,” he read. Then he showed the paper to newspapermen. It was dated July 11, 1938. ‘“That’s how we operate,” he said, “we knew all along how this thing would come out.”
