Misses Mother's
Funeral Despite Policemen’s Aid
CHICAGO, Aug. 25 (U. P).— Marital difficulties landed Forrest Webb Holder in County Jail last
April and he could not get out for his mother’s funeral even with the help of the Connersville, Ind., police. He went to jail because he failed to post a $1500 bond, insuring his yesidence within the jurisdiction of the court where a divorce suit filed by his wife was pending. Mrs. Holder got the divorce in June, but the court order calling for the bond mistakenly was allowed to stand, so Mr. Holder remained in jail. Connersville . authorities wired Chicago officials yesterday asking if Mr. Holder could be released to attend his mother’s funeral. The reply was that nothing could be done until Superior Judge J. J. Lupe, who committed Mr. Holder, returned from his vacation next

Evidence at Kidnap Trial
Will ‘Shake

Lal
State, Is Pledge
OLYMPIA, ‘Wash. Aug. 25 (U. P.) —State’s Attorney Smith Troy today announced that at the trial of Dr. K. W. Berry on charges of kidnaping and assaulting Irving Baker, 37, he would introduce evidence
that would “shake the state.” Mr. Troy declined to say what< the evidence was, but indicated that it had to do with a three-day party at a summer cottage. He said the party was attended by prominent, residents of Tacoma, Seattle and Bremerton, many of whom he. said would be called to testify at Dr. Berry’s trial.
Dr. Berry previously had said it was at a Fourth of Juy party when Mr. Baker, a former Coast Guard officer, was too attentive to Elizabeth Berry, the physician's attractive 27-year-old wife. Several days before the attack on Mr. Baker, Dr. Berry had complained to authorities about the friendliness of the former Coast Guard officer to his wife but he had declined to file charges. Dr. Berry and his wife moved in’ Olympia’s best social circles and often were guests of state officials. Three others have been charged with complicity in the kidnaping and assault. They are William McAloon, Robert W. Smith, dairyman for whom Dr. Berry had served as family physician, and James Reddick, taxi cab driver. Police also took into custody Harold Shars, taxi cab driver, who was charged with being an accessory. Authorities contended that he knew of the beating but failed to report
it. Mr. McAloon and Mr. Smith |
signed statements accusing Dr. Berry of instigating the plot against Mr. Baker, Mr. McAloon said he was too drunk to remember a great deal of what happened when Mr. Baker was taken to a lonely rock quarry, but he recalled a few incidents. “Berry tried to beat Baker into saying he seduced his wife at a party, but Baker denied that all the time Berry was kicking and beating him,” McAloon said.

Trapped
Japanese Beetles Are Discovered in Six Hoosier Cities.
Having located the cities infected with Japanese beetles, the State ~onservation Department today prepared to remove its traps and to begin treatment to eliminate these insects. Beetles were trapped this year in Ft. Wayne, Indianapolis, Logansport, South Bend, East Chicago and Elkhart. Traps placed at Jeffersonville, Auburn, New Albany, Marion, Kokomo, Huntington, Lagrange, Gary, Crown Point, Whiting, Hammond, Hobart, Griffith, LaPorte, Anderson, Peru, Albion, Kendallville, Valparaiso, Mishawaka, Angola, Lafayette and Wabash showed these cities were not infected. The Conservation Department is co-operating with the U. S. Department of Agriculture in this elimination campaign. Treatment consists of an application of an arsenate of lead solution to the soil. Department officials said: the beetles first were reported in Indianapolis last year in the vicinity of Meridian and 30th Sts. The arsenate of lead treatment was used, and no beetles were found in that neighborhood this year. Report from several eastern states indicate that the Japanese beetle has caused heavy damage in those areas, officials said.

T0 NEW SLAYING
Dwyer’ S Aocixation Backed
By Affidavit of Another 2 Witness.
(Copyright. 1938. by United Press) AUBURN, ‘Me, Aug. 25.—Paul
(Buddy) Dwyer, 19, serving a life
{ sentence for the same murder as
that of which former Deputy Sheriff Francis Carroll was con-
victed, has accused Carroll of a
third ‘murder, state prison officials revealed today. Carroll, like Dwyer, is serving a life sentence for the slaying of Dr. James G. Littlefield, South Paris physicion. He also was accused of but not tried for the murder of the doctor’s wife. Now, prison officials said, Dwyer has accused Carroll of slaying John W. Penney, Auburn filling station proprietor. Prison officials said er made his Accusation “about two months ago.” It was not disclosed, however, until today after the brother of a former state official in an affidavit had placed Carroll at Penney’s isolated filling station on the night of last May 18, the night on which Penney was beaten to death.
Probe Relationship
In accusing Carroll of the third slaying, Dwyer told prison officials that Carroll and the Penneys were related by marriage. Sheriff Rex
| V. Bridges of Androscoggin County
said he would interview the slain man's widow; Mrs. Viola Carroll Penney, concerning any such relationship. : Prison officials quoted Dwyer as saying that Carroll had visited the Penneys “many times” seeking funds to finance his escape from South Paris. Dwyer’s accusation, officials said, was that, refused money, Car= roll became involved in an argument with Mr. Penney that resulted in the lajter’s death. Though Dwyer was serving his life sentence at the time Mr. Penney was slain, Sheriff Bridges said this did no! preclude Dwyer’'s knowledge of Carroll's alleged visits to the Penneys. “He (Dwyer) had plenty of visitors at the prison,” the sheriff said. Police said that at first Mrs. Pen-
ney believed robbery had motivated
her husband’s murder, but that now she discounts that theory. : From his home at Turner, Sheriff Bridges told of the new turn in the investigation of the Penney slaying.
‘Came Voluntarily’
“Day before yesterday,” the Sheriff said, “George Violette, who says he is a brother of the late Neil Violette, former State Forestry Commisioner, came to my office voluntarily and made the sworn statement. : “It concerned events which supposedly transpired at the scene shortly before the killing of Penney. “I asked Mr. Violette why he had not made his report earlier, and he explained that he had no reason for suspecting a man who at that time was a deputy sheriff. “I am investigating Mr. Violette’s statement thoroughly. I questioned him all day yesterday and plan to question him further. Right now I am by no means satisfied that the statement is entirely correct. But if investigation confirms it, I probably will submit- the case to the Androscoggin Grand Jury next month.”
NOTE IN BOTTLE GOES 1000 MILES ON RIVER
NASHVILLE Tenn. Aug. 25 (U. P.).—A note sealed in a bottle and tessed into the Cumberland River has started a friendship between two boys more than 1000 miles apart. It began a year ago when Carl S. McMurray Jr. sealed three identical notes in three bottles and dropped them off the Woodland Street bridge here into the Cumberland River. The notes requested their finders to communicate with young McMurray. The bottles drifted down the river with the current. One of them navigated the Cumberland to the Ohio, and finally went down the Mississippi until it was washed ashore on the west bank of the stream at Plaquemine, La. There it was picked up by Percy | Herbert, who unsealed the bottle and answered the note.
