Lester Smithers, former president of the Yancey local of the United Mine Workers, was killed in Harlan County and Clyde and Verlin Fee, brothers, were held in connection with the crime. It was not believed, however, that that killing had any connection with the trial, but merely was a brawl. Lee Fleenor, a deputy sheriff on trial here, was arrested in connection with the shooting of Charlie Reno Tuesday night, but that was said to be a mountain feud rather than an outgrowth of the trial.

Otis in Federal Court today, and while won probation, it was the other. who stood alon® and friendless, who excited the court's sympathies. Robert Hoskins, 18, Stanberry, demanded $300 from Dr. Edward D. Criswell of Stanberry and threatened, in a letter, to kill him if the money was not paid. HosKins pleaded guilty. Judge Otis sentenced him to five years each on two counts. Beside Hoskins was Sylvanus Jahue Watson, 17, Grant City, who was charged with rifling 14 lockboxes in the Grant City Postoffice. He also pleaded guilty Judge Otis sentenced him to two years at a reformatory. “This boy is the son of a convict who is now reputed to be the town drunkard,” said Judge Otis in speaking of Watson. “He comes here alone. He has no friends and no witnesses appear for him. He has served two terms in the State Reformatory. But in pleading guilty this boy had a thought for his family and asked to be put in jail and not in prison. He didn’t threaten anyone with death.
