His company is a defendant, but he is not. a conference of defense and Government lawyers at the judge's bench as soon as Mr. Cornett was sworn, later it was learned that he had declined to testify on the grounds that he might incriminate his company and himself. all coal mined by the Harlan-Wal- | lins Co. and agreed to dispose of it.
A long line of witnesses remained to be called today. It was assumed that all of them either would stand on their constitutional rights or would contend the coal passed out
of their control at the mine mouths. |

Leo Gardner Home Here From Philippine Islands.
Mr. and Mrs. Leo M. Gardner had returned to Indiana today from the Philippine Islands where he was legal adviser to High Commissioner Paul V. McNutt. Mr. Gardner said he still is on official business and will not be relieved until Aug. 15. He said he will go on to Washington in two days. Mr. Gardner said he and his famfly are happy to be back in Indiana, and that although they enjoved the experience in the Philippines, they have no desire to live there. He said Commissioner McNutt's administration of the Islands was “going fine—everyone thinks his is the best administration ever had and evervone likes him.”

LAWRENCE. Kan, June 15 (U P)-Dr. DD W. Kurtz, Laverne Cal, a former president of McPherson College, McPherson, Kan., was the new moderator today of the Church of the Brethren He was elected at the annual business meeting at the University of Kansas, Dr. Otho Winger, president of Manchester College, North Manchester, Ind., and W. Newton Long, Baltimore, were named members of the general mission board.

LONDON, June 15 (U. P.).—Sir Arthur Frederick Richards, high commissioner for the Western Pacific, has been named Captain General and Governor-in-Chief of Jamaica, British West Indies, it was announced today. Sir Arthur succeeds the late Sir Edward Denham.

An estimated 35,000 to 45,000 per- | | sons in Indiana between 65 and 69 | vears old will apply for state oldage assistance when this age group becomes eligible for aid July 1, the State Welfare Board predicted today. Under the provisions of an amendment to the Social Security Act, the age limit of persons eligible for assistance was lowered from 70 to 65, effective July 1. More than 42,000 in the state now are receiving assistance in the age group above 70. A “complete study” of every applicant to determine his or her eligibility has been ordered by the Board.
Resource Study Required
“The welfare act is very explicit in requiring that every resource of the applicant be ascertained, to determine whether or not his total income is sufficient to meet his needs,” the Board stated. “Social, religious or political status cannot possibly make an applicant eligible or keep him eligible, {even though he may become a recipient of public assistance tem- | porarily.” ili | If eligible, however, the recipient | of aid should receive “a reasonable | | subsistence compatible with decency | and health,” Board members said.
