SCHOOL BUS DRIVERS GET TAX EXEMPTION

Ruling Says Operators Not Subject to Weight Law.

NOBLESVILLE, June 3 (U. P.).— Approximately 7000 State schcol bus | drivers today are exempt from the | new Indiana motor vehicle weight | tax law following a ruling by Ham- | © ilton Circuit Court Judge Cassius | M. Gentry. The law, which was bitterly op- | posed by the new drivers’ associa- | tion at the last session of the State Legislature, does not apply to school busses or school bus drivers, Judge Gentry ruled. The case was filed in Hamilton Circuit Court by Joseph Newby and sought to enjoin Donald F. Stiver, superintendent of the State Police, and Sheriff A. K. Baker of Hamilton County irom enforcing the law against school bus drivers. Judge Gentry asserted that prop- | erty used for educational purposss is exempt frcm taxation; that the school bus is a passenger vehicle operated by a political subdivision of the State; and that arrests of drivers not complying with the law would impair their contracts with Township Trustees. Drivers declared the law was class legislation; that they were not doing a commercial business and were not hauling pupils for hire in a manner which passengers are transported on busses; that the extra weight tax would increase their annual expenditure from $25 to $30 for each driver, and that their contracts with Township Trustees would be impaired because of the extra expense without additional revenue.

PRISON TO MAKE BRICK DELIVERY

Private Firm Waives Right To Supply Material for Julietta Building.

The delivery of brick to be used in the construction of a dining room wing at the Julietta Infirmary is to be started immediately by the State Prison, Dow W. Vorhies, County Commissioners’ president said today. The announcement was made after the Capitol City Supply Co. which had been awarded a contract to supply the brick, informed the Commissioners that it would waive

the right to deliver because of a conflict with State law. * After awarding the contract, the Commissioners learned that contracts for such material as can be furnished by State Prison factories cannot be-awarded to private concerns. The delay in delivering the material is expected to postpone the completion of the wing by several days. Foundations have been poured and made ready for use of the brick for several days, it was reported. The Capitol company’s bid on 35,000 bricks was $19 a thousand. The State's bid was $15 a thousand.
