The Indiana Appellate Court has reversed a Marion County Superior Court decision in which Millard

Keith, spectator at the 1935 race, was awarded a $300 judgment against the Indianapolis Motor Speedway Corp. The original judgment was obtained on the plaintiff's evidence that he was struck by an Indianapolis policeman while waiting to get into the Speedway. The lower court had ruled that the officer was acting as an agent of the Speedway, as proved by the fact | that he was able to go in and out | of the grounds without a ticknt. In ordering a new trial and reversing this juagment, the Appellate Court said: “The mere fact that the officer entered the grounds without a ticket would not show that he was a servant or agent of the Speedway. This court is entirely familiar with the | customs wnich prevail for uniformed officers to enter such places without | tickets.”

POLICE WIN STORK RACE | BY 24 HOURS

Mrs. Rebecca Parker, 18, today called a cab to her home, 1229 Naomi St., and told the driver to rush her to Coleman Hospital. “I'm going to have a baby away,” she said. Ray Goddard, the driver. went instead to the Police Station. to get permission to break traffic rules getting Mrs. Parker to the hospital. Police called a radio car which was only half block away. Patrolmen Otto Fulton and Charles Hocioga placed Mrs. Parker in their car and rushed her to Coleman. Coleman physicians said Mrs. Parker’s baby probably will be born tomorrow |
