Free to Become Citizen as 4-Year Fight Ends.
NEW ORLEANS, April 8: (U. P.). —Joseph George Strecker was free to become an American citizen today after winning a four-year fight | against deportation for having joined the Communist Party.
The Fifth U. 8. Circuit Court of Appeals ruled that “membership in the Communist Party, standing alone, is not sufficient to warrant deportation.” Judge Joseph C. Hutcheson, who wrote the opinion for the court, said that the “red scare” acts of 1918 and 1929 under which Strecker was charged, “do not forbid membership in any / party except one which teaches the overthrow by force and violence of the Government of the United States.” “Russia is more vigorously organized than any other country in the world to prohibit and suppress those who teach and preach the overthrow 8 Sovernment by force,” the court - said. Strecker migrated 26 years ago from Austria. He took out first citizenship papers and applied for final ones. ' In 1932 he joined the Communist party. He said he be‘lieved "democracy and peace for everybody,” but was against “big business and billionaires.”
