WATER FIRM'S CASE DRAFTED FORRATE TRIAL

Commission Reply on Issue Of Evaluation Due Not Later Than March 17.

Counsel for the Indianapolis Water Co. today prepared a brief

outlining views regarding evalua-

tion for rate-making purposes in its seven-year-old rate case against the Indiana Public Service Commission. The brief, which is to be filed by March 12, was ordered yesterday by Federal Judge Robert C. Baltzell Commission attorneys are to file an answer within five days later. The case began in 1932 when the company appealed to Federal District Court here after the Public Service Cammission’s order setting a new valuation and lower rates. The company charged the rates were confiscatory and discriminatory. —~ Company Wins Appeal

Judge Baltzell set a valuation at more than 21 million three years later and ordered rates fixed on a basis of 6 per cent return. The company appealed to the Circuit Court of Appeals at Chicago, which reversed Judge Baltzell’s ruling and ordered him to enjoin the commission from enforcing the new rates and evaluation. The Attorney. General appealed to the Supreme Court, which held that Judge Baltzell, in his 1935 opinion. had failed to take into consideration changing price trends, including labor prices, in the three years since the suit was filed. Wiiliam I. Ransom of New York, water company attorney, declared at yesterday's hearing that the Supreme Court order referring the case back to District Court binds the lower court to values found in the original valuation. He said “it’s our duty now to find changes that occurred in the intervening years.”

New Evidence Possible

Deputy Attorney General Urban Stover, Commission attorney, contended the case’s return to the District Court “opens the issue to all additional evidence that would affect the question of values for rate establishment.” Judge Baltzell said he thought the Court should consider all evidence in the former trial as to income and values with each side having the right to introduce testimony touching specific items. :

Proper Firing of Furnaces Topic Again Tonight.

T. A. Day, Cincinnati, Appalachian Coals, Inc. official and former Purdue University engineer, is to speak at the second session of the Combustion Institute tonight at Hotel Washington. First session, sponsored by the Indianapolis Smoke Abatement League and Indianapolis Retail Coal Merchants Association, was held last Saturday. The institute, conducted to present information on proper firing of furnaces, is open to the public without charge.
