4 SURE OF CASH IN STORK DERBY
Jwo Other Claimants Ask Share at Final Plea in Toronto Today.
. TORONTO, Ontario, Feb. 25 (U. P.).—The final hearing: on distri“bution of the stakes in Toronto's $500,000 “Baby Derby” today found * four mothers assured of a fortune and two others clamoring for shares. Justice W. E. Middleton called the contestants before him for what was expected to be a stormy session. The four sure to share in the prize for having the most babies in 10 years are Mrs. John Nagle, Mrs. Alfred Smith, Mrs. Arthur Timleck ‘and Mrs. John MacLean. + «Still refusing to concede defeat sare Mrs. Martin Kenny and Mrs. * Pauline Mae Clark. The six “finalists” claim nine children were born to each of them between Oct. 31, 1926, and Oct. 31, 1936, the 10-year period which ‘started when bachelor Charles Vance Miller willed the residue of his estate to the Toronto mother who bore the most children within 10 years of his death.
Four Claims Are Admitted
The estate’s executors have ad- . mitted formally the claims of the first four. Mrs. Clarke’s claim was questioned on the grounds her five youngest children were born after her husband left her. The problem facing Mrs. Kenney is to prove that _ three of the nine children whose births she has had registered were not stillborn, as declared on the certificates. - Justice Middleton has held that stillborn children cannot be counted. The justice also ruled last Novem- « ber that only mothers of legitimate children were eligible. His ruling was upheld by the Appellate Court and the Canadian Supreme Court.
