Opponents of the plan to raze the Cumberland Community Building on the Warren Central School grounds ‘today refused an offer of Charles M. Walker, trustee, to give them the building if they would, move it from
the school yard. “We don’t want it torn down and we don’t want it moved,” William Gale ‘declared. “There is no good reason for moving it.” Plans to raze the structure were halted when a group headed by Mr. Gale and Edwin C. Huntington was
granted a temporary restraining or-.
der by Judge Joseph R. Williams of Superior Court 2. Arguments on a permanent injunction are io be heard March 5. Mr. Gale disputed Mr. Walker's assertion that the building had been condemned by the State Fire Marshal. :
Improvements Made
“The building is in better shape now than it ever was,” Mr. Gale declared. “Between $1200 and $1500 has been spent on it in the past few months. There are sanitary facilities in it now and structural defects have been fixed.”
Representatives: .of Cumberland civic organizations will discuss the situation tomorrow night at the school building. Delegates, Mr. Gale said, are to represent the Baptist, Methodist and German churches, the Parent-Teachers Association, the Boy Scouts and some taxpayers. He asserted a majority of the community’s 600 residents oppose raz-
.| ing the structure.
Mr. Gale said the building was erected originally by the Y. M.C. A:
at Speedway City; and that: it was ||

vacation Bible schools’ and as a recreation center for children. Mr. Walker had charged the
building was a menace to the school and that a majority of the residents wanted it removed. . It had been used mainly for dances during the past ‘two years, he ‘said, The Masonic Temple Boosters, who have sponsorefl dances there, announced today that they intended to. hold future functions in a building at Post Road and E. Washington St. Mr. Walker also charged that those who attended dances committed acts of vandalism in the adjoining cemetery, where many Civil War veterans are buried. With the building removed, he said, it would be easier to restore and maintain the cemetery.
PODIATRISTS SET MEETING The Indiana Podiatrists Association is to convene April: 23 to 25° at Hotel Lincoln, it was announced today. Dr. Harry Trusters, Mishawaka, and Dr. Paul Killen, Marion, have been named science’ committee cochairmen.

REVERSED BY COURT|
The- v. 8. Circuit Court of Appeals at Chicago today had held that the Federal gift tax is applicable to homes purchased by husband or wife if held in joint title, according to word received here. The ruling reversed. the decision of District Judge Robert C. Baltzell who held that Josiah K. Lilly Jr. was entitled to recover more than $16,000 in gift tax payments on a property held in title by Mr. and Mrs. Lilly. They were named “tene ants .by entirety.” The tax applies to gifts of $50,000 or more.
